【摘要】：在定罪基礎(chǔ)上,免刑(免予刑事處罰)是與判刑相對(duì)應(yīng)的刑事處遇。當(dāng)前"醉駕"實(shí)踐呈現(xiàn)出案件數(shù)量逐年上升但免刑比例偏低,刑罰投入巨大而刑罰效益卻無明顯改觀的面相。重刑主義的盛行、理論的分歧和司法機(jī)制和環(huán)境是掣肘"醉駕"免刑實(shí)踐的諸多因素,而順應(yīng)司法現(xiàn)代化要求、縮減刑罰化的負(fù)效應(yīng)和對(duì)抽象危險(xiǎn)犯的妥協(xié)性正義,要求擴(kuò)大"醉駕"免刑實(shí)踐。擴(kuò)大免刑實(shí)踐需要根據(jù)刑法第37條的"情節(jié)輕微"和"不需要判處刑罰"兩個(gè)方面量刑情節(jié)進(jìn)行實(shí)質(zhì)性和系統(tǒng)性解讀,并完善文書說理以搭建"醉駕"免刑司法綜合實(shí)踐平臺(tái)。
[Abstract]:On the basis of conviction, commutation (exemption from criminal punishment) is the corresponding criminal punishment. At present, the practice of "drunk driving" shows that the number of cases increases year by year, but the proportion of impunity is on the low side, and the penalty investment is huge but the penalty benefit is not obviously improved. The prevalence of severe punishment, the divergence of theory and the judicial mechanism and environment are the factors that restrict the practice of "drunk driving", and conform to the request of judicial modernization, reduce the negative effect of penalty and compromise justice to the abstract dangerous crime. Demands to expand the practice of "drunk driving" exemption from punishment. In order to expand the practice of exemption from punishment, it is necessary to carry out substantive and systematic interpretation of the circumstances of sentencing in terms of "minor circumstances" and "no penalty" in Article 37 of the Criminal Law, and to perfect the reasoning of documents in order to set up a comprehensive practical platform for judicial practice of "drunk driving".
