【摘要】：近年來,我國刑法學研究獲得了長足的發(fā)展,在基礎(chǔ)理論問題和實務問題上都展開了深入而又廣泛的探討和研究。主要梳理我國2010—2015年期間刑法學研究的重要內(nèi)容及其學術(shù)觀點。在刑法學基礎(chǔ)理論問題方面介紹了犯罪論、違法性論、刑法解釋學與刑罰論;在重大現(xiàn)實問題方面介紹了勞教廢止后的刑法應對與死刑改革問題;在熱點罪名方面主要介紹《刑法修正案》(八)、(九)所涉及的危險駕駛罪、貪腐犯罪、恐怖犯罪等罪名。由此勾勒出我國刑法學最新發(fā)展的動態(tài)和脈絡(luò)。在此基在礎(chǔ)之上,總結(jié)并評價我國刑法學科前沿發(fā)展的總體狀況及發(fā)展趨勢。
[Abstract]:In recent years, the research of criminal law in our country has made great progress, and has carried out deep and extensive research on the basic theoretical and practical problems. This paper reviews the important contents and academic viewpoints of criminal law research in China from 2010 to 2015. It introduces the theory of crime, the theory of illegality, the hermeneutics of criminal law and the theory of penalty in the aspect of basic theory of criminal law, and introduces the countermeasures of criminal law and the reform of death penalty after abolition of reeducation through labor. In the aspect of hot crimes, this paper mainly introduces the crimes of dangerous driving, corruption, terrorism and so on. From this outline our country criminal law newest development dynamics and the vein. On the basis of this, the general situation and development trend of the frontier development of criminal law in China are summarized and evaluated.
