【摘要】："兩高"最新貪賄案件司法解釋對(duì)特定數(shù)額的規(guī)定,賦予了非數(shù)額情節(jié)"降格入罪"、"升檔量刑"的功能,這是非常吻合立法原意的。但該司法解釋對(duì)受賄行為八種非數(shù)額情節(jié)的歸納存在著突破立法關(guān)于死刑適用條件、未能實(shí)現(xiàn)對(duì)選人用人環(huán)節(jié)腐敗情形閉合治理和全覆蓋懲治、未能對(duì)具有特定職務(wù)身份國家工作人員予以精準(zhǔn)懲治、將"謀取不正當(dāng)利益"情形與次生危害后果綁定等不足。從立法完善的角度看,應(yīng)當(dāng)根據(jù)身份職責(zé)、謀取利益性質(zhì)、行為方式等情形將非數(shù)額情節(jié)予以類型化規(guī)定。
