【摘要】：正從近年來(lái)查處的賄賂案件來(lái)看,越來(lái)越多的受賄者為規(guī)避法律懲處,利用職權(quán)上的便利為他人謀取利益后并不親手收受賄賂,而是指使其近親屬等"身邊人"充當(dāng)"白手套",實(shí)行"曲線受賄",此類行為影響惡劣。2007年7月,最高人民法院、最高人民檢察院聯(lián)合發(fā)布《關(guān)于辦理受賄刑事案件適用法律若干問(wèn)題的意見(jiàn)》(以下稱《意見(jiàn)》),明確了認(rèn)定非國(guó)家工作人員構(gòu)成共同受賄犯罪的基本原則,為打擊國(guó)家工作人員及其"身邊人"共同受賄犯罪提供了法律依據(jù)。但是,從司法實(shí)踐效果來(lái)看,依據(jù)上述規(guī)定懲處國(guó)家工作人員的特定關(guān)系人共同受賄犯罪仍然存在缺陷:該規(guī)定將有"通謀"作為特定關(guān)系人構(gòu)成共同受賄犯罪的主觀要件,認(rèn)定標(biāo)準(zhǔn)過(guò)于苛刻,在訴訟中存在證明困難。因此,需要根據(jù)該類共同
