【摘要】：《刑法修正案(八)》自2011年5月1日正式頒布實(shí)施以來,因其是歷次刑法修改中力度最強(qiáng)、范圍最廣的一次修改,無論在理論研究界還是司法實(shí)踐中都產(chǎn)生深遠(yuǎn)而持久的影響,受到社會各界的廣泛關(guān)注。其主要內(nèi)容一是對有些刑罰進(jìn)行了調(diào)整,二是進(jìn)一步加強(qiáng)了刑法對民生的保護(hù),加重了對一些嚴(yán)重侵犯人民群眾生命安全的一些犯罪行為的處罰,這給以監(jiān)獄為主的刑罰執(zhí)行機(jī)關(guān)帶來長遠(yuǎn)影響�！缎谭ㄐ拚�(八)》的頒布實(shí)施一方面它完善了我國的刑罰結(jié)構(gòu),有利于進(jìn)一步懲罰和預(yù)防犯罪,維護(hù)社會的穩(wěn)定和和諧；而另一方面由于它未充分考慮到我國當(dāng)前刑罰執(zhí)行工作的現(xiàn)狀,與當(dāng)前“給出路”的教育改造方法產(chǎn)生違背,過分加重了監(jiān)獄等刑罰執(zhí)行機(jī)關(guān)的負(fù)擔(dān),給社會埋下了新的隱患。本文擬就《刑法修正案(八)》實(shí)施對刑罰執(zhí)行工作產(chǎn)生的影響作一些分析探討,同時結(jié)合自身工作實(shí)踐提出相關(guān)建議,以期引起大家對監(jiān)獄工作的重視,對我國刑罰執(zhí)行工作的進(jìn)步發(fā)展盡綿薄之力。盡管隨著我國全面深化改革的不斷深入,國家刑事司法體系在不斷完備,但刑罰體系,尤其是監(jiān)獄刑罰執(zhí)行工作若想真正地符合法治社會要求,體現(xiàn)社會之公平正義,仍然任重道遠(yuǎn)。

The main content is to adjust some penalties. The two is to further strengthen the protection of the criminal law on the livelihood of the people, and aggravate some of the criminal acts that seriously infringe on the lives of the people, which has a long-term impact on the prison based penalty executive. The promulgation and implementation of the amendment of the criminal law (eight) has perfected the structure of our country's penalty, which is conducive to further development. Punishment and prevention of crime, maintaining social stability and harmony, on the other hand, because it does not fully take into account the current situation of the implementation of the criminal penalty in our country, and the current "way out" of the educational reform method is violated, overly aggravated the prison and other penalty execution organs burdens, and put new hidden danger to the society.
