【摘要】：P2P網(wǎng)絡(luò)貸款平臺(tái)作為一種新興的金融交易模式,隨著互聯(lián)網(wǎng)的進(jìn)一步普及而迅猛發(fā)展。但相比于國(guó)外P2P網(wǎng)絡(luò)借貸平臺(tái)相對(duì)安全的運(yùn)營(yíng)模式和較為完善的監(jiān)管制度,我國(guó)大量出現(xiàn)的P2P網(wǎng)絡(luò)借貸平臺(tái)仍然存在許多問(wèn)題與風(fēng)險(xiǎn),其中不乏眾多刑事風(fēng)險(xiǎn)與漏洞。由于行業(yè)缺乏監(jiān)管,亂象叢生,導(dǎo)致了一系列侵害投資者利益和擾亂金融秩序的惡性事件。P2P網(wǎng)絡(luò)貸款平臺(tái)自身介入借貸活動(dòng)是否構(gòu)成非法吸收公眾存款罪也是各界學(xué)者討論的熱點(diǎn)。對(duì)于P2P網(wǎng)絡(luò)借貸平臺(tái)的發(fā)展及其存在的風(fēng)險(xiǎn)應(yīng)如何管控仍需進(jìn)一步的探討。
[Abstract]:As a new financial transaction mode, P2P network loan platform is developing rapidly with the popularization of Internet. However, compared with foreign P2P network lending platform relatively safe operation mode and relatively perfect supervision system, there are still many problems and risks in China's P2P network lending platform, among which there are many criminal risks and loopholes. As a result of the lack of regulation in the industry, It leads to a series of pernicious events that infringe the interests of investors and disturb the financial order. Whether the involvement of P2P network loan platform in lending activities constitutes the crime of illegally absorbing public deposits is also a hot topic for scholars from all walks of life. How to control the development and risk of P2P network lending platform needs further discussion.
