【摘要】：隨著互聯(lián)網(wǎng)科技的日益發(fā)展,網(wǎng)絡(luò)空間逐漸成長為能夠與現(xiàn)實(shí)社會(huì)媲美的文化空間、生活空間、商業(yè)空間。微信“朋友圈”作為近年來火爆社交圈的熱門產(chǎn)品,其無門檻無限制的貨物交易方式在一定程度上便利了眾多微信用戶,也為大量違法產(chǎn)品的涌現(xiàn)提供了場所,間接地使得微信“朋友圈”成為不少黑心商家的致富溫床。如何有效規(guī)制個(gè)人商家在“朋友圈”的經(jīng)營行為,遏制已經(jīng)出現(xiàn)的違法犯罪現(xiàn)象的擴(kuò)散,有效促進(jìn)懲治犯罪和預(yù)防犯罪的社會(huì)效果的實(shí)現(xiàn),在現(xiàn)有的國家法律法規(guī)防控治理手段中,刑事法律也應(yīng)發(fā)揮其該存在的作用。本文思路是通過對“朋友圈”非法經(jīng)營活動(dòng)中產(chǎn)生的犯罪問題進(jìn)行分析,以彌補(bǔ)當(dāng)前“朋友圈”經(jīng)營犯罪問題刑事規(guī)制手段的不足。本文首先展開對“朋友圈”經(jīng)營行為的概述,主要講述“朋友圈”經(jīng)營模式的內(nèi)涵及其不同于其他經(jīng)營模式的特點(diǎn),接著通過概述微信“朋友圈”不法經(jīng)營現(xiàn)象存在的危害引入刑法規(guī)制手段介入的正當(dāng)性和適度性,然后具體分析刑事手段規(guī)制“朋友圈”經(jīng)營犯罪可能出現(xiàn)的困境,最后立足于“朋友圈”經(jīng)營犯罪規(guī)制難點(diǎn)和問題討論怎樣去規(guī)制“朋友圈”犯罪行為。網(wǎng)絡(luò)商品交易經(jīng)濟(jì)發(fā)展已有十多年歷史,各大電子商務(wù)平臺也在逐步的發(fā)展完善,建立在微信社交平臺上的“朋友圈”經(jīng)營模式打開了新型移動(dòng)網(wǎng)絡(luò)交易的大門�！芭笥讶Α苯灰捉o電子商務(wù)經(jīng)濟(jì)的發(fā)展帶來了新的挑戰(zhàn),其產(chǎn)生的一系列社會(huì)問題也增添了法律法規(guī)對其應(yīng)有的管制壓力。本文將立足于“朋友圈”經(jīng)營行為中產(chǎn)生的各種問題,針對商品經(jīng)營犯罪網(wǎng)絡(luò)異化產(chǎn)生新犯罪形式、犯罪方法等問題,通過分析研究刑法對于網(wǎng)絡(luò)經(jīng)營違法犯罪現(xiàn)象的規(guī)制手段來促進(jìn)移動(dòng)網(wǎng)絡(luò)經(jīng)濟(jì)的健康發(fā)展。
[Abstract]:With the development of Internet technology, cyberspace has gradually grown into a cultural space, a living space and a commercial space comparable to the real society. WeChat's "friend circle", as a popular product in social circle in recent years, has provided a place for the emergence of a large number of illegal products, because of its unlimited trade in goods, to a certain extent, it has facilitated many users of WeChat, and has also provided a place for the emergence of a large number of illegal products. Indirectly makes WeChat "friend circle" become the rich hotbed of a lot of black-hearted businessman. How to effectively regulate the business behavior of individual businessmen in the "circle of friends", curb the spread of the phenomenon of illegal crime, effectively promote the realization of the social effect of punishing crime and preventing crime, In the existing national laws and regulations prevention and control measures, the criminal law should also play its role. The idea of this paper is to analyze the criminal problems arising from the illegal operation of the "circle of friends", in order to make up for the deficiency of the criminal regulation means of the "circle of friends" in the operation of the crime at present. This paper begins with an overview of the business behavior of the "circle of friends", and mainly describes the connotation of the "circle of friends" business model and its characteristics, which are different from other business models. Then it introduces the legitimacy and appropriateness of criminal law regulation means to intervene by summarizing the harm of illegal operation phenomenon in WeChat's "friend circle", and then analyzes the predicament that may appear in criminal means to regulate "friend circle" management crime. Finally, based on the difficulties and problems of "friend circle" management crime regulation, how to regulate "friend circle" crime behavior is discussed. The network commodity trade economy has developed for more than ten years, each major electronic commerce platform is also gradually developing and consummating. The "friend circle" management mode established on the WeChat social platform has opened the door of the new mobile network transaction. The "circle of friends" transaction has brought new challenges to the development of electronic commerce economy, and a series of social problems have also increased the control pressure due to the laws and regulations. This article will be based on the "circle of friends" business behavior arising from various problems, in view of the commodity business crime network alienation to produce new forms of crime, crime methods and other issues, Through the analysis of the criminal law for the regulation of the phenomenon of illegal network operation means to promote the healthy development of mobile network economy.
