【摘要】：海峽兩岸的反恐立法,近年來均有所進(jìn)展。兩岸開展反恐立法協(xié)調(diào),可自立法層面推進(jìn)兩岸間的反恐交流與合作,可自反恐議題推進(jìn)兩岸間的立法交流與合作。兩岸民間的反恐立法協(xié)調(diào),雖處相對較低的位階,但卻是極其重要的基礎(chǔ)性合作,可以促進(jìn)各自法域內(nèi)反恐立法的改革與完善。兩岸兩會的準(zhǔn)官方溝通管道,為兩岸反恐立法協(xié)調(diào)所急需,可以有所作為。兩岸警政業(yè)務(wù)主管機(jī)關(guān)可直接開展官方談判,漸次簽署反恐宣言、反恐協(xié)議以及反恐專項協(xié)議,形成兩岸反恐立法協(xié)調(diào)的區(qū)際網(wǎng)絡(luò)。這是一個特殊的職權(quán)立法活動,操作比較便捷,所簽署的文件的法律性質(zhì)較之兩岸兩會達(dá)成的協(xié)議應(yīng)是更加明確,并且也不損及"一個中國"的政治原則。
[Abstract]:Anti-terrorism legislation on both sides of the Taiwan Strait has made some progress in recent years. The coordination of anti-terrorism legislation between the two sides of the strait can promote the anti-terrorism exchanges and cooperation between the two sides of the strait from the legislative level, and the legislative exchanges and cooperation between the two sides of the strait from the anti-terrorism issue. Although the coordination of anti-terrorism legislation between the two sides of the strait is relatively low, it is an extremely important basic cooperation, which can promote the reform and perfection of anti-terrorism legislation in their respective jurisdictions. The two sides of the strait semi-official communication channels, cross-straits anti-terrorism legislation coordination needs, can make a difference. The authorities in charge of police affairs on both sides of the strait can directly conduct official negotiations and gradually sign anti-terrorism declarations, anti-terrorism agreements and special anti-terrorism agreements, thus forming an inter-regional network for the coordination of cross-Strait anti-terrorism legislation. This is a special legislative activity with functions and powers, and the operation is relatively convenient. The legal nature of the documents signed should be clearer than the agreement reached between the two associations, and it should not undermine the political principle of "one China."
