【摘要】：對行政執(zhí)法工作中可能產(chǎn)生的瀆職犯罪相關(guān)問題進行探討,一方面可以促進行政執(zhí)法機關(guān)依法行政、積極行政,另一方面也可限制司法權(quán)過度侵入行政執(zhí)法領(lǐng)域。"兩法銜接"中的瀆職犯罪僅包括三種犯罪,即徇私舞弊不移交刑事案件罪、放縱制售偽劣商品犯罪行為罪、放縱走私罪。在實行行政首長負(fù)責(zé)制的行政執(zhí)法領(lǐng)域,由于決策命令制定及實施而發(fā)生瀆職犯罪的,應(yīng)當(dāng)根據(jù)犯意特征、行為特征、行為與結(jié)果的因果關(guān)系,具體分析主要責(zé)任人、直接主管人員和直接責(zé)任人員的瀆職責(zé)任。"兩法銜接"瀆職罪"原案"對本案認(rèn)定影響重大,在肯定"原案"是本案的犯罪對象的基礎(chǔ)上,應(yīng)結(jié)合"原案"內(nèi)涵、性質(zhì)和特征等因素綜合考慮"原案"在定罪量刑中的作用。
[Abstract]:On the one hand, it can promote the administrative law enforcement agencies to administer according to law, and actively administrate, on the other hand, it can limit the judicial power to intrude excessively into the field of administrative law enforcement. " The crime of dereliction of duty in the connection of the two laws includes only three kinds of crimes, namely, the crime of favoritism, the crime of not transferring criminal cases, the crime of indulging in the production and sale of fake and inferior commodities, and the crime of indulging in smuggling. In the field of administrative law enforcement under the executive head responsibility system, if a dereliction of duty is committed as a result of the formulation and implementation of a decision order, the principal responsible person shall be specifically analyzed according to the characteristics of the criminal intent, the causal relationship between the act and the result, Dereliction of duty on the part of the person directly in charge and of the person directly responsible. " The connection of the two laws with "the original case of dereliction of duty" has a great impact on the determination of the case. On the basis of affirming that the "original case" is the object of the crime in this case, the connotation of the "original case" should be combined. The nature and characteristics of the factors such as the "original case" in the conviction and sentencing role.
