【摘要】：《刑法修正案(九)》針對(duì)外國(guó)恐怖主義參戰(zhàn)人員進(jìn)行了必要而及時(shí)的規(guī)定,將資助恐怖活動(dòng)培訓(xùn)、為恐怖活動(dòng)培訓(xùn)招募、運(yùn)送人員的行為、組織恐怖活動(dòng)培訓(xùn)或者積極參加恐怖活動(dòng)培訓(xùn)的行為以及為參加恐怖活動(dòng)組織、接受恐怖活動(dòng)培訓(xùn)或者實(shí)施恐怖活動(dòng)而偷越國(guó)(邊)境的行為犯罪化。從刑法的行為規(guī)制功能出發(fā),在法規(guī)競(jìng)合的場(chǎng)合,如無(wú)法條明確規(guī)定,應(yīng)堅(jiān)持特別法優(yōu)于普通法的原則,在涉及外國(guó)恐怖主義參戰(zhàn)人員的案件中,選擇適用特殊法條的規(guī)定。為了有效預(yù)防外國(guó)恐怖主義參戰(zhàn)人員的跨國(guó)流動(dòng),尤其是在以間歇式旅行的方式奔赴目的國(guó)情況日漸增多的情況下,進(jìn)行嚴(yán)格的邊境管理、展開(kāi)有效的多邊合作是必要之舉。
[Abstract]:The Criminal Law Amendment (9) has made necessary and timely provisions for the participation of foreign terrorist fighters in the training of terrorist activities, the recruitment and transportation of personnel for the training of terrorist activities, The organization of terrorist training or active participation in terrorist training, as well as the offence of smuggling across the border of a country or border in order to participate in terrorist activities, to receive training in terrorist activities or to carry out terrorist activities. Starting from the function of behavioral regulation of criminal law, in the case of overlapping laws and regulations, the principle that special law is superior to common law should be adhered to, and the provisions of special law should be applied in cases involving foreign terrorist war participants. In order to effectively prevent the transnational movement of foreign terrorist personnel, especially in the case of intermittent travel to the destination country, strict border management and effective multilateral cooperation are necessary.
