【摘要】：盡管我國(guó)刑法已經(jīng)規(guī)定了無限防衛(wèi)權(quán),但是目前的正當(dāng)防衛(wèi)制度仍然解決不了人民的維護(hù)自身權(quán)利不受侵犯的迫切需要,解決不了各級(jí)法院和檢察院在處理正當(dāng)防衛(wèi)案件時(shí)的巨大爭(zhēng)議,由此正當(dāng)防衛(wèi)規(guī)定迫切需要完善。我們應(yīng)該借鑒外國(guó)的法律規(guī)定,從根源上改變我國(guó)正當(dāng)防衛(wèi)制度縛足不前的現(xiàn)狀,并以此為鑒對(duì)我國(guó)法治社會(huì)建設(shè)程度進(jìn)行反思。
[Abstract]:Although the criminal law of our country has stipulated the unlimited right of defense, the current system of legitimate defense still cannot meet the urgent need of the people to safeguard their rights and not to be infringed. Courts and procuratorates at all levels can not solve the huge dispute in dealing with legitimate defense cases, so the legitimate defense provisions need to be improved urgently. We should learn from the foreign laws and regulations, change the current situation of our country's legitimate defense system from the root, and take this as a mirror to reflect on the degree of the construction of our country's society ruled by law.
