【摘要】：近年來,故意傷害罪呈現(xiàn)出犯罪方式復(fù)雜化、傷害個(gè)案多樣化的發(fā)展態(tài)勢,胎兒傷害、精神傷害、傳播傳染性病原體等特殊傷害情形增加,傳統(tǒng)刑法理論上“傷害”的內(nèi)涵和外延已經(jīng)表現(xiàn)出不適應(yīng)司法實(shí)踐發(fā)展的需要,導(dǎo)致司法機(jī)關(guān)對于特殊傷害的認(rèn)定顯得“無所適從”,刑法學(xué)界對此也展開了激烈討論。因此,有必要對于“傷害”概念的內(nèi)涵與外延重新進(jìn)行界定,對于上述特殊傷害情形進(jìn)行研究與探討。本文主要論述了傷害的含義、精神傷害、胎兒傷害、故意傳播傳染性病原體這四個(gè)問題,筆者在提倡尊重個(gè)人的價(jià)值,特別是精神價(jià)值,以及提倡全面保護(hù)人體健康的基礎(chǔ)之上,提出筆者自己的觀點(diǎn)。人體健康分為軀體健康和精神健康兩個(gè)方面,傷害的客體應(yīng)該包括精神健康權(quán);以往的生理機(jī)能損害說無法囊括所有的傷害情形,因此采健康狀態(tài)惡化說較為適宜。采用裝神弄鬼、威脅、恐嚇等精神刺激方式,致使他人大腦功能活動(dòng)發(fā)生紊亂,出現(xiàn)認(rèn)知、意志和行為等方面的精神功能紊亂或缺失,嚴(yán)重?fù)p害他人精神健康的,也應(yīng)認(rèn)定為傷害。另外,關(guān)于胎兒傷害,刑法應(yīng)該承認(rèn)胎兒的主體性地位,承認(rèn)胎兒享有生命健康權(quán)益,并增設(shè)故意傷害胎兒罪。對于針對特定對象故意傳播傳染性病原體的行為,若傳播可治愈的傳染性病原體,應(yīng)認(rèn)定為故意傷害罪,若傳播艾滋病等不可治愈的傳染性病原體,應(yīng)認(rèn)定為故意殺人罪。最后,筆者認(rèn)為,傷害概念具有再造必要性,以刑法的人文精神為基點(diǎn),對傷害概念進(jìn)行再造。
[Abstract]:In recent years, the crime of intentional injury has shown the complexity of the crime mode, the development trend of the diversification of injury cases, the increase of special injuries such as fetal injury, mental injury, transmission of infectious pathogens, etc. The connotation and extension of "harm" in traditional criminal law theory has shown that it does not meet the needs of the development of judicial practice, which leads the judicial organs to be "at a loss" in the determination of special injuries, which has been discussed intensely in the field of criminal law. Therefore, it is necessary to redefine the connotation and extension of the concept of "injury", and to study and discuss the above special injury situation. This paper mainly discusses the meaning of injury, mental injury, fetal injury, intentional transmission of infectious pathogens these four issues, the author is advocating respect for the value of the individual, especially the spiritual value, On the basis of advocating the overall protection of human health, the author puts forward his own views. Human health can be divided into two aspects: physical health and mental health. The object of injury should include mental health; the former theory of physiological function damage can not cover all the injury situations, so it is more appropriate to adopt the theory of deterioration of state of health. The use of mental stimulation, such as pretentious, threatening, intimidating, and other mental stimuli, resulting in disorders of other people's brain function, resulting in mental disorders or deficiencies in cognition, will, and behavior, which seriously impair the mental health of others, It should also be recognized as injury. In addition, with regard to fetal injury, the criminal law should recognize the subjective status of the fetus, recognize that the fetus enjoys the rights and interests of life and health, and add the crime of intentionally harming the fetus. For the behavior of deliberately spreading infectious pathogens to specific objects, if the infectious pathogens that can be cured are transmitted, the crime of intentional injury should be recognized, and the crime of intentional homicide if the transmission of infectious pathogens such as AIDS is incurable. Finally, the author believes that the concept of injury has the necessity of reengineering, based on the humanistic spirit of criminal law, to reconstruct the concept of injury.
