【摘要】：日前,我國(guó)的科學(xué)技術(shù)伴隨著經(jīng)濟(jì)水平的提升得到了快速的發(fā)展,互聯(lián)網(wǎng)、金融、電信行業(yè)等漸漸融入人們的生活,使用率頻繁,這無(wú)形當(dāng)中提升了人們的生活質(zhì)量,但現(xiàn)代技術(shù)在人們使用的過(guò)程中存在著諸多的問(wèn)題,電信詐騙就是典型的例子,給社會(huì)的發(fā)展帶來(lái)了嚴(yán)重的阻礙。電信詐騙犯罪作為高速發(fā)展的信息時(shí)代新生出來(lái)的一種新類(lèi)型犯罪,主要利用手機(jī)短信、固定電話(huà)、互聯(lián)網(wǎng)等各種通訊、通信工具和現(xiàn)代網(wǎng)上銀行等先進(jìn)技術(shù)實(shí)施的詐騙犯罪,作案手段的科技化、智能化,作案手法不斷更新、欺騙性強(qiáng),此類(lèi)犯罪在日常生活中的屢屢發(fā)生,危害結(jié)果也越來(lái)越嚴(yán)重,這引起了法制學(xué)界和社會(huì)的廣泛關(guān)注。本文首先將對(duì)電信詐騙犯罪的相關(guān)概念、現(xiàn)狀、特點(diǎn)以及危害等內(nèi)容進(jìn)行詳細(xì)分析;將我國(guó)和國(guó)外面臨電信詐騙犯罪在刑事方面所采取的相關(guān)對(duì)策進(jìn)行闡述和對(duì)比,進(jìn)而提出預(yù)防電信詐騙犯罪刑事對(duì)策的相關(guān)建議,更加長(zhǎng)效地打擊和遏制此類(lèi)犯罪,從而促進(jìn)社會(huì)的長(zhǎng)遠(yuǎn)發(fā)展。具體來(lái)說(shuō),本文分為以下四個(gè)部分:第一部分主要論述的是不同學(xué)者對(duì)電信詐騙犯罪的定義、特點(diǎn)和危害。該部分通過(guò)不同學(xué)者對(duì)電信詐騙犯罪概念的理解,從而對(duì)電信詐騙犯罪的概念進(jìn)行了重新的定義,并說(shuō)明了目前該類(lèi)犯罪對(duì)人類(lèi)日常生活的巨大不良影響。第二部分主要論述的是對(duì)我國(guó)電信詐騙犯罪的制度概覽進(jìn)行了梳理,并著重對(duì)我國(guó)刑事立法的現(xiàn)狀進(jìn)行了分析,并尋找其存在的不足之處。第三部分主要論述的是從國(guó)外打防電信詐騙犯罪的刑事立法體系入手,總結(jié)并歸納出各國(guó)立法的特點(diǎn),并與我國(guó)立法模式進(jìn)行比較,得出了能使我國(guó)在立法過(guò)程中可以借鑒的經(jīng)驗(yàn)和啟示。第四部分是針對(duì)我國(guó)目前在電信詐騙犯罪立法方面的缺陷,并借鑒國(guó)外立法的優(yōu)勢(shì),對(duì)我國(guó)在該類(lèi)犯罪的立法上提出建議,具體包括對(duì)罪名體系的完善、提高法定刑的配置、增加有關(guān)對(duì)數(shù)據(jù)保護(hù)的立法等。
[Abstract]:A few days ago, China's science and technology developed rapidly along with the improvement of the economic level. The Internet, finance, telecommunications and other industries gradually integrated into people's lives, and the utilization rate was frequent. This invisible has improved people's quality of life. However, there are many problems in the process of using modern technology. Telecom fraud is a typical example, which brings serious obstacles to the development of society. As a new type of crime emerging from the high-speed information age, the crime of telecom fraud is mainly committed by using various kinds of communication, communication tools and advanced technologies such as mobile phone short message, fixed telephone, Internet and so on. The crime means of science and technology, intelligence, crime methods are constantly updated, deceptive strong, such crimes in daily life, the harm of the results are more and more serious, which has caused widespread concern in the legal community and society. In this paper, the concept, current situation, characteristics and harm of telecom fraud crime are analyzed in detail, and the relevant countermeasures in criminal aspects of telecom fraud crime in our country and abroad are expounded and compared. Then it puts forward the relevant suggestions to prevent the crime of telecom fraud, and to combat and contain the crime more effectively, thus promoting the long-term development of the society. Specifically, this paper is divided into the following four parts: the first part mainly discusses the definition, characteristics and harm of telecom fraud by different scholars. Through different scholars' understanding of the concept of telecom fraud crime, this part redefines the concept of telecom fraud crime, and explains the great negative impact of this kind of crime on human daily life. The second part mainly discusses the system overview of China's telecom fraud crime, and focuses on the analysis of the current situation of our criminal legislation, and find its shortcomings. The third part mainly discusses the criminal legislation system of fighting telecom fraud crime in foreign countries, summarizes and summarizes the characteristics of various countries' legislation, and compares it with the legislative model of our country. The experience and enlightenment that can be used for reference in the legislative process of our country are obtained. The fourth part is aimed at the defects in the legislation of telecom fraud crime in our country, and draw lessons from the advantages of foreign legislation, and put forward some suggestions on the legislation of this kind of crime, including the perfection of the crime system and the improvement of the allocation of statutory punishment. Add legislation on data protection, etc.
