【摘要】：以“9.11”事件為肇始的恐怖主義犯罪愈演愈烈,不斷地挑戰(zhàn)人類社會的道德倫理底線,嚴重地影響地區(qū)安全與世界和平。近年來,恐怖主義犯罪在我國也呈現出頻發(fā)、高發(fā)態(tài)勢,嚴重阻遏了我國構建和諧社會、平安中國的進程。借助法律的強制手段來懲治日益猖獗的恐怖主義犯罪活動,己經成為國際社會的共識。加強反恐立法、完善有關法律對策的研究勢在必行、刻不容緩。我國法律立場鮮明地反對暴力恐怖主義犯罪,并且我國政府積極參與國際反恐合作。但在懲治恐怖主義犯罪的立法上,尤其是國際反恐合作立法方面,我國相對滯后�？偨Y分析我國懲治恐怖主義犯罪方面立法實踐的不足,借鑒學習當今國際先進的反恐經驗和完善的法律成果,有助于完善我國懲治恐怖主義犯罪的立法,加強國際反恐合作,這對于懲治恐怖犯罪、推進平安中國、構建和諧社會意義重大。本文從闡釋恐怖主義犯罪的概念及法律特征入手,通過剖析國際懲治恐怖主義犯罪的法律對策,并且結合我國的反恐立法實踐,提出了完善我國懲治恐怖主義犯罪的立法建議。除引言和結語外,本文共分四部分。第一部分是關于恐怖主義犯罪的基本概述。厘定了恐怖主義犯罪的概念,并且分析了恐怖主義犯罪的歷史成因及其發(fā)展趨勢;第二部分是國際懲治恐怖主義犯罪的立法分析。本章先分析西方主要發(fā)達國家的反恐立法實踐,并介紹了國際反恐合約,歸納出懲治恐怖主義犯罪的立法特點;第三部分,分析我國懲治恐怖主義犯罪方面的立法實踐及其不足。本章從介紹我國反恐法律實踐入手,進而剖析我國懲治恐怖主義犯罪面臨的法律困境;第四部分,完善我國懲治恐怖主義犯罪的法律對策。主要圍繞完善懲治恐怖主義犯罪的立法模式的選擇、立法原則的確立,以及制定反恐專門法、完善我國現行刑事法律等方面提出了個人建議。
[Abstract]:The terrorist crime, which began with the "9.11" incident, is becoming more and more serious, which constantly challenges the bottom line of morality and ethics of human society and seriously affects regional security and world peace. In recent years, the crime of terrorism in our country also presents the frequency, the high incidence situation, has seriously inhibited our country to construct the harmonious society, the peace China's progress. It has become the consensus of the international community to punish the increasingly rampant terrorist crime by means of the compulsory means of law. It is imperative to strengthen the anti-terrorism legislation and perfect the relevant legal countermeasures. Our legal stand is clear against violent terrorist crimes, and our government actively participates in international anti-terrorism cooperation. However, our country lags behind in the legislation of punishing terrorist crimes, especially in international anti-terrorism cooperation legislation. By summing up and analyzing the deficiency of our country's legislative practice in punishing terrorist crimes and learning from the international advanced experience and perfect legal achievements, it is helpful to perfect our legislation on punishing terrorist crimes and to strengthen international cooperation against terrorism. This is of great significance for punishing terrorist crimes, promoting peaceful China and building a harmonious society. This paper begins with the interpretation of the concept and legal characteristics of terrorist crime, analyzes the legal countermeasures of international punishment of terrorist crime, and puts forward some legislative suggestions to perfect the punishment of terrorism crime in our country in the light of our country's anti-terrorism legislative practice. In addition to the introduction and conclusion, this article is divided into four parts. The first part is the basic overview of the crime of terrorism. This paper defines the concept of terrorist crime, and analyzes the historical causes and development trend of terrorist crime. The second part is the legislative analysis of international punishment of terrorist crime. This chapter first analyzes the anti-terrorism legislation practice of the western major developed countries, and introduces the international anti-terrorism contract, summarizes the legislative characteristics of punishing terrorist crimes; part three, This paper analyzes the legislative practice and its deficiency in punishing the crime of terrorism in our country. This chapter begins with the introduction of our country's anti-terrorism legal practice, and then analyzes the legal dilemma that our country faces in punishing the terrorist crime; the fourth part, consummates our country's legal countermeasure to punish the terrorist crime. This paper puts forward some personal suggestions on how to perfect the legislative mode of punishing terrorist crimes, the establishment of legislative principles, the formulation of special laws against terrorism, and the perfection of our country's current criminal laws.
