【摘要】：作為特定“人之圖像”的弱者圖像,對我國刑事立法與司法均有深遠影響,向我們提出了刑法如何關注弱者的命題,但現(xiàn)有研究對于弱者圖像的觀察與預設還有待深化。特別是在步入全媒體時代的媒介化社會中,更應從多個側(cè)面認識和呈現(xiàn)刑法中的弱者圖像。在充分理解弱式意義上的刑法平等原則的基礎上,也應當反思以弱者保護為主題的民生法治建設中可能存在的理論誤區(qū)與不當做法。通過對弱者圖像的刑法深描與學理反思,更應當在未來的刑事立法與司法中警惕民生刑法觀的異化、汲取象征性立法的教訓、避免污名化現(xiàn)象的出現(xiàn)、減少民粹式司法的影響。
[Abstract]:As a special "image of people", the image of the weak has a profound influence on the criminal legislation and judicature in our country. The proposition of how to pay attention to the weak in criminal law has been put forward to us, but the observation and presupposition of the image of the weak still need to be deepened. Especially in the media society of the whole media age, we should recognize and present the image of the weak in criminal law from many aspects. On the basis of fully understanding the principle of the equality of criminal law in the weak sense, we should also reflect on the possible theoretical misunderstanding and improper practices in the construction of the people's livelihood rule of law with the protection of the weak as the theme. Through the deep description and theoretical reflection of the image of the weak in criminal law, we should guard against the alienation of the concept of criminal law of people's livelihood in the future criminal legislation and judicature, draw lessons from symbolic legislation, avoid the appearance of stigmatization, and reduce the influence of populist justice.
