【摘要】：近年來,我國媒體曝光了一系列震驚全國的刑事錯案,如內蒙古呼格吉勒圖案、福建黃興、林立峰、陳夏影案等。這些錯案的頻繁發(fā)生,不僅嚴重損害了這些被冤者的合法權利,而且嚴重損害了中國刑事司法制度的權威,損傷了司法的公信力。刑事錯案發(fā)生數量的多寡和嚴重程度已經成為衡量一個國家司法文明的風向標,如何有效防范刑事錯案的發(fā)生是中國司法界面臨的重要課題。文章立足于我國當前的司法環(huán)境,從內蒙古呼格吉勒圖冤殺案著手,探索案件引發(fā)的法律問題,通過對我國刑事訴訟程序運行過程中存在的錯誤司法理念、不合理的刑事司法機制、不規(guī)范的證據裁判規(guī)則等的分析,研究刑事錯案發(fā)生的原因,結合我國當前的司法現狀,旨在從轉變刑事司法理念、堅持證據裁判規(guī)則、強化刑事審判機制、加強刑事辯護和訴訟監(jiān)督制度、完善錯案救濟機制等方面提出我國刑事錯案的法律防范措施。
[Abstract]:In recent years, Chinese media have exposed a series of criminal cases that shocked the whole country, such as Huugjilt case in Inner Mongolia, Huang Xing case in Fujian Province, Lin Lifeng case, Chen Xia Ying case and so on. The frequent occurrence of these wrong cases not only seriously damages the legitimate rights of the aggrieved persons, but also seriously damages the authority of China's criminal justice system and the credibility of the judiciary. The number and severity of criminal misdeeds have become the vane to measure the judicial civilization of a country. How to prevent the occurrence of criminal wrong cases effectively is an important issue facing the judicial circles in China. Based on the current judicial environment of our country, this paper begins with the case of Huugjilt's unjust killing in Inner Mongolia, explores the legal problems caused by the case, and analyzes the wrong judicial ideas existing in the course of the operation of criminal procedure in our country. The analysis of unreasonable criminal justice mechanism, irregular rules of evidence adjudication, the study of the causes of the occurrence of criminal malpractice, and the current judicial situation of our country are aimed at changing the concept of criminal justice and insisting on the rules of evidence adjudication. Strengthening the criminal trial mechanism, strengthening the criminal defense and lawsuit supervision system, perfecting the remedy mechanism of the wrong case, and so on, puts forward the legal prevention measures of the criminal wrong case in our country.
