【摘要】：以條件公式為唯一標準的傳統(tǒng)因果關(guān)系理論,已經(jīng)無法滿足產(chǎn)品刑事責任領域結(jié)果歸責的現(xiàn)實需求。晚近以來出現(xiàn)的疫學因果關(guān)系和風險升高理論,是一種與傳統(tǒng)條件關(guān)系型因果完全不同的新興結(jié)果歸責類型。在產(chǎn)品刑事責任領域引入此類概率提升型因果,能有效解決實踐中大量存在的由于無法將行為的不法部分與其他作用因素相分離而難以認定具體因果關(guān)系,以及一般因果法則尚不明確的結(jié)果歸責難題。當然,由于概率提升型因果在本質(zhì)上降低了事實關(guān)聯(lián)性程度的要求,容易造成刑法歸責范圍的擴張,因而其在產(chǎn)品刑事責任中的適用范圍也應受到嚴格限定。
[Abstract]:The traditional causality theory with conditional formula as the sole standard can no longer meet the actual demand of product criminal liability result imputation. Recently, the theory of epidemic causality and increased risk is a new type of result imputation completely different from the traditional conditional causality. Introducing this kind of probabilistic ascending causality in the field of product criminal responsibility can effectively solve the problem that the illegal part of the act can not be separated from other factors in practice, which makes it difficult to identify the specific causality. And the result imputation difficult problem that general causality law is not clear yet. Of course, the probabilistic promotion causality in essence reduces the requirement of fact relevance, and it is easy to cause the expansion of criminal liability scope, so its application scope in product criminal liability should be strictly limited.
