【摘要】：作為官吏贓罪制裁手段,資格刑在中國有著悠久的歷史。官吏犯贓是權(quán)力的濫用,對贓吏適用資格刑,剝奪其為官的權(quán)利,是中國古代重典治吏、權(quán)力制約的重要環(huán)節(jié)。傳統(tǒng)法律之官吏贓罪資格刑,是蘊(yùn)含著官德要求的刑罰,即以德作為權(quán)力制約的內(nèi)在支撐,以刑作為權(quán)力制約的外在手段,是一種儒法結(jié)合的權(quán)力制約措施。資格刑對遏制官吏犯贓、打擊貪官污吏、保證吏治清明、弘揚(yáng)優(yōu)良社會風(fēng)氣、穩(wěn)定社會秩序等,皆有不可忽視的積極作用�？疾靷鹘y(tǒng)法律之官吏贓罪資格刑,可獲得有益的借鑒與啟示。
[Abstract]:As a means of punishing official crime of stolen goods, qualification penalty has a long history in China. It is an important link of power restriction for officials to abuse power, to apply qualification punishment to stolen officials and to deprive them of their right to serve as officials. The qualification penalty of official crime in traditional law is the penalty which contains the request of official morality, that is, taking morality as the internal support of power restriction and punishment as the external means of power restriction, is a kind of power restriction measure combined with Confucianism and law. The qualification penalty plays an important role in curbing the corrupt officials, attacking corrupt officials, guaranteeing Pure Brightness, carrying forward the fine social atmosphere and stabilizing the social order. To investigate the qualification penalty of official crime in traditional law can be used for reference and enlightenment.
