【摘要】：實踐中在認(rèn)定"造成惡劣社會影響"時存在邏輯認(rèn)識誤區(qū),應(yīng)該科學(xué)地把握"瀆職行為""直接危害結(jié)果""其他重大非物質(zhì)損失后果"與"造成惡劣社會影響"的關(guān)系。在"造成惡劣社會影響"證據(jù)體系中,媒體報道、引發(fā)信訪、上級重視、證人證言成為實踐中比較常見的證據(jù),準(zhǔn)確把握上述證據(jù)的證明力和收集運用要點至關(guān)重要。應(yīng)從準(zhǔn)確理解"造成惡劣社會影響"的關(guān)鍵證明要素、構(gòu)建規(guī)范的"造成惡劣社會影響"審查評判方法、明確"造成惡劣社會影響"的證明說理邏輯、嚴(yán)格準(zhǔn)確作出"造成惡劣社會影響"的認(rèn)定等四個方面,構(gòu)建科學(xué)的證明路徑,保證"造成惡劣社會影響"的準(zhǔn)確認(rèn)定。
[Abstract]:In practice, there is a logical misunderstanding in the determination of "bad social impact", so we should scientifically grasp the relationship between "malfeasance", "direct harm result," "other major non-material loss consequences" and "bad social impact". In the evidence system of "causing bad social impact", the media reports, causes the letter and visits, the superior pays attention, the witness testimony becomes the more common evidence in the practice, accurately grasps the above evidence the proof power and the collection application key point is very important. It is necessary to accurately understand the key proof elements of "causing adverse social impact", to construct a standard method of examining and judging "causing adverse social impact", and to clarify the reasoning logic of "causing adverse social impact". This paper makes strict and accurate identification of "bad social impact", and constructs a scientific proof path to ensure the accurate identification of "causing bad social impact".
