【摘要】：知識產(chǎn)權(quán)法是我國法律體系中的重要組成部分,近年來我國法律針對知識產(chǎn)權(quán)犯罪行為的定罪標(biāo)準(zhǔn)也呈現(xiàn)出逐漸降低的趨勢。在此過程中,我國刑罰制度的嚴(yán)厲度卻在不斷加大,知識產(chǎn)權(quán)侵權(quán)行為產(chǎn)生的概率依然較高,知識產(chǎn)權(quán)刑法犯罪的嚴(yán)重性不斷加重。這一變化現(xiàn)象表明,隨著知識產(chǎn)權(quán)侵權(quán)行為日漸多樣化,僅僅依靠刑罰手段難以對其進(jìn)行嚴(yán)厲打擊和規(guī)制;相反,要想進(jìn)一步完善現(xiàn)階段我國知識產(chǎn)權(quán)刑罰保護(hù)法律制度、體系,應(yīng)逐步協(xié)調(diào)和統(tǒng)一當(dāng)前我國民法與刑法對知識產(chǎn)權(quán)侵權(quán)行為的認(rèn)定結(jié)果,從而優(yōu)化知識產(chǎn)權(quán)犯罪刑法結(jié)構(gòu),確保刑法對我國知識產(chǎn)權(quán)侵權(quán)行為法律打擊的"高壓化"和"常態(tài)化"。在此基礎(chǔ)上,完善現(xiàn)階段我國刑事司法與行政執(zhí)法銜接機(jī)制。
[Abstract]:Intellectual property law is an important part of the legal system of our country. In recent years, the standard of conviction for intellectual property crimes in our country has gradually decreased. In this process, the severity of our country's penalty system is increasing, the probability of intellectual property infringement is still high, and the seriousness of criminal law of intellectual property is becoming more serious. This phenomenon shows that, with the diversification of intellectual property infringement, it is difficult to crack down and regulate it only by means of punishment. On the contrary, it is necessary to further improve the present legal system of criminal protection of intellectual property rights in China. In order to optimize the criminal law structure of intellectual property crime, the system should gradually coordinate and unify the results of the recognition of intellectual property infringement in the current civil law and criminal law of our country. To ensure the "high-pressure" and "normality" of the criminal law against the infringement of intellectual property rights in China. On this basis, improve the current criminal justice and administrative law enforcement convergence mechanism.
