【摘要】：隨著市場經濟的不斷發(fā)展，精神衛(wèi)生問題越來越受到公眾的關注，一系列的精神病人司法案件對社會的影響，也引發(fā)我們的深思，新刑事訴訟法加入精神病人刑事強制醫(yī)療這一特殊程序，是我國強制醫(yī)療制度發(fā)展的一個新的階段。最高院、最高法也相應的出臺了相關的司法解釋，可見，我國強制醫(yī)療制度基本形成了一個較為完備的雛形，保證了公安機關能夠依據法律的規(guī)定處理相關的案件。但是精神病人強制醫(yī)療程序已經適用一年多，越來越多的問題也逐漸顯現，因為是首次入律，，所以在相關法律程序的制定上難免存在諸多不足，為此，眾多學者表示擔憂，如何保障該弱勢群體的利益不可不察。截至目前，最高人民法院以及最高人民檢察院已經對相關法律法規(guī)的理解、適用制定了司法解釋，但是立法者亦存在法律制定中的“有限理性”，存在對相關問題的理解有偏差，或者是滯后于社會實際，從而造成了在司法解釋之中存在諸多不盡如人意之處，紕漏難免。有鑒于此，筆者認為，實有必要立足于新修訂的《刑事訴訟法》第五編第四章“依法不負刑事責任的精神病人的強制醫(yī)療程序”之規(guī)定，結合司法機關之司法實踐，透之以理論剖析，對依法不負刑事責任的精神病人的強制醫(yī)療程序的適用進行研究，從而保障刑事強制醫(yī)療措施能夠得到正確的實施，實現保障精神病人人權和社會防衛(wèi)、正義的目的。筆者從理論出發(fā)，概括性的剖析了精神病人強制醫(yī)療程序在適用中存在的問題，重點總結了解決適用中存在問題的合理建議，主要包括適用范圍、鑒定程序、審判程序、配套保障、權利救濟等方面。
[Abstract]:With the continuous development of the market economy, mental health problems have been paid more and more attention to by the public. A series of judicial cases of mental patients have had an impact on the society, which has also aroused our deep thinking. The new criminal procedure law is a new stage in the development of compulsory medical treatment system in China. The Supreme Court and the Supreme Law have also issued relevant judicial explanations. It can be seen that China's compulsory medical system has basically formed a relatively complete embryonic form, ensuring that the public security organs can deal with relevant cases according to the provisions of the law. However, compulsory medical procedures for mental patients have been applied for more than a year, and more and more problems have gradually emerged. As this is the first time to enter the law, there are inevitably many deficiencies in the formulation of relevant legal procedures. For this reason, many scholars have expressed concern. How to protect the interests of this vulnerable group can not be ignored. Up to now, the Supreme people's Court and the Supreme people's Procuratorate have formulated judicial interpretations on the understanding of relevant laws and regulations, but legislators also have "limited rationality" in the formulation of laws. There are some deviations in the understanding of related problems, or lag behind the social reality, which results in many unsatisfactory points in the judicial interpretation, which is unavoidable. In view of this, the author believes that it is necessary to base on the provisions of Chapter 4 of title 5 of the newly revised Criminal procedure Law, "compulsory medical procedures for mental patients who are not criminally liable according to law", and to combine the judicial practice with the judicial organs. Through theoretical analysis, this paper studies the application of compulsory medical procedures for mental patients who are not criminally responsible according to law, so as to ensure that the criminal compulsory medical measures can be correctly implemented, and realize the protection of the human rights and social defense of mental patients. The purpose of justice. Based on the theory, the author analyzes the problems existing in the application of compulsory medical procedure for mental patients, and summarizes the reasonable suggestions for solving the problems in application, including the scope of application, appraisal procedure, trial procedure, and so on. Supporting protection, right relief and so on.
