【摘要】：隨著改革開(kāi)放的不斷深入以及社會(huì)經(jīng)濟(jì)的迅猛發(fā)展,隨之而來(lái)出現(xiàn)了日益嚴(yán)重的環(huán)境問(wèn)題,環(huán)境污染和生態(tài)破壞已經(jīng)給我們帶來(lái)了巨大的危害,其已成為我國(guó)目前面臨的一個(gè)重大的社會(huì)問(wèn)題。我國(guó)的環(huán)境刑事立法由于起步比較晚,在立法的價(jià)值理念、環(huán)境刑事犯罪具體內(nèi)容規(guī)定、環(huán)境犯罪的處罰等很多方面還是存在很多的不足之處,存遏制和懲罰環(huán)境犯罪、保護(hù)環(huán)境資源方面并未發(fā)揮應(yīng)有的作用,鑒于我國(guó)環(huán)境刑事立法目前存在的諸多缺陷以及我國(guó)環(huán)境犯罪的現(xiàn)實(shí)狀況和未來(lái)將會(huì)出現(xiàn)的變化,為了更好的預(yù)防和懲罰環(huán)境犯罪,解決我國(guó)嚴(yán)重的環(huán)境污染和資源破壞問(wèn)題,保護(hù)自然資源和生態(tài)環(huán)境,本文通過(guò)分析我國(guó)刑事環(huán)境立法面臨的具體問(wèn)題以及我國(guó)環(huán)境刑事立法的不足,對(duì)比其他國(guó)家的立法成果,借鑒發(fā)達(dá)國(guó)家的相關(guān)立法經(jīng)驗(yàn)提出一些在環(huán)境刑事立法方面的建議,以完善我國(guó)的環(huán)境犯罪的刑事立法,更好的發(fā)揮刑法在環(huán)境保護(hù)方面的重要作用。
[Abstract]:With the deepening of reform and opening up and the rapid development of social economy, with the emergence of increasingly serious environmental problems, environmental pollution and ecological destruction have brought us great harm. It has become a major social problem facing our country at present. The environmental criminal legislation of our country starts relatively late. There are still many deficiencies in many aspects, such as the value concept of legislation, the specific content of environmental criminal crime, the punishment of environmental crime, etc., which contain and punish environmental crime. The protection of environmental resources has not played its due role. In view of the current defects of our environmental criminal legislation and the actual situation and future changes of environmental crimes in our country, in order to better prevent and punish environmental crimes, To solve the serious problems of environmental pollution and resource destruction, to protect natural resources and ecological environment, this paper analyzes the specific problems faced by our criminal environmental legislation and the shortcomings of our country's environmental criminal legislation. Comparing with the legislative achievements of other countries, and drawing lessons from the relevant legislative experience of developed countries, some suggestions on environmental criminal legislation are put forward in order to perfect the criminal legislation of environmental crime in our country. Better play the important role of criminal law in environmental protection.
