【摘要】：未成年犯罪問題是眾多國(guó)家關(guān)注的重點(diǎn)，尤其是對(duì)未成年犯刑罰執(zhí)行進(jìn)行了廣泛的研究。其不僅關(guān)乎刑罰體系的完善，而且對(duì)于未成年人權(quán)利的保護(hù)有重要作用。未成年人作為社會(huì)弱勢(shì)群體，法律賦予其很多特殊權(quán)利，以保障其在社會(huì)上的生存和發(fā)展。處于刑罰執(zhí)行中的未成年犯居于絕對(duì)的弱勢(shì)地位，，非但人身自由等一些權(quán)利受到限制，刑罰執(zhí)行制度的科學(xué)與否，刑罰執(zhí)行環(huán)境的適當(dāng)與否都會(huì)影響其權(quán)利的維護(hù)。對(duì)未成年犯進(jìn)行刑罰的目的在于使其接受教育改造，消除人身危險(xiǎn)性而走向社會(huì)。未成年犯的最終走向還是融入社會(huì)，因此，在刑罰執(zhí)行中應(yīng)當(dāng)注重未成年犯的社會(huì)化改造和發(fā)展。 第1章引言部分，主要是介紹了國(guó)內(nèi)各學(xué)者對(duì)未成年犯的研究情況，闡述了選題依據(jù)和意義。 第2章主要是對(duì)未成年犯刑罰理論進(jìn)行概述，介紹了日益嚴(yán)峻的未成年犯形勢(shì)，列舉了專門適用于未成年犯的刑罰體系，并講述了對(duì)未成年犯施以刑罰所應(yīng)堅(jiān)持的原則。 第3章則是論述在刑罰執(zhí)行中對(duì)未成年犯進(jìn)行權(quán)利保護(hù)的必要性，不僅有理論依據(jù)，還有法律依據(jù)。對(duì)未成年犯的權(quán)利介紹則是為權(quán)利保護(hù)的必要性論述做鋪墊。 第4章域外未成年犯的刑罰執(zhí)行制度研究，則是為了探究在刑罰執(zhí)行中，國(guó)外對(duì)未成年犯的權(quán)利保護(hù)措施，并給我國(guó)提供借鑒。 第5章則是分析當(dāng)今我國(guó)未成年犯刑罰執(zhí)行制度的不完善，對(duì)未成年犯的權(quán)利保護(hù)不到位，并結(jié)合前文中的理論分析和指導(dǎo)，提出合理的完善措施。 第6章結(jié)論部分整體回顧了文章的內(nèi)容，再次強(qiáng)調(diào)在刑罰執(zhí)行中對(duì)未成年犯進(jìn)行權(quán)利保護(hù)的重要性，以及完善我國(guó)未成年犯刑罰執(zhí)行制度的必要性。
[Abstract]:Juvenile crime is the focus of attention in many countries, especially the juvenile penalty execution has been widely studied. It not only relates to the perfection of penalty system, but also plays an important role in protecting the rights of minors. As a social vulnerable group, the law gives minors many special rights to ensure their survival and development in society. Juvenile criminals who are in the execution of punishment are in an absolutely weak position. Not only some rights such as personal liberty are restricted, but also the scientific or not of penalty execution system, the proper or not of the execution environment of penalty will affect the maintenance of their rights. The purpose of punishment for juvenile criminals is to make them accept education and reform, eliminate personal danger and go to society. The final trend of juvenile delinquents is to integrate into society, so we should pay attention to the socialization reform and development of juvenile delinquents in the execution of penalty. The first chapter introduces the domestic scholars' research on juvenile delinquents, and expounds the basis and significance of the topic. The second chapter summarizes the criminal penalty theory of juvenile delinquents, introduces the increasingly serious situation of juvenile delinquents, enumerates the penalty system that is specially applicable to juvenile offenders, and describes the principles that should be adhered to in imposing penalties on juvenile offenders. The third chapter discusses the necessity of protecting the rights of juvenile offenders in the execution of penalty, not only on the theoretical basis, but also on the legal basis. The introduction of the rights of juvenile delinquents is to lay the groundwork for the discussion of the necessity of the protection of rights. The fourth chapter is to study the penalty enforcement system of foreign juvenile delinquents in order to explore the protection of juvenile delinquents' rights in foreign countries and to provide reference for our country. Chapter 5 is to analyze the imperfection of penalty execution system of juvenile delinquents in our country, and to protect the rights of juvenile delinquents in place, and to put forward the reasonable perfect measures combined with the theoretical analysis and guidance mentioned above. The conclusion part of chapter 6 reviews the content of the article, and emphasizes the importance of protecting the rights of juvenile offenders in the execution of penalty, and the necessity of perfecting the penalty enforcement system of juvenile delinquents in our country.
