【摘要】："以非法占有為目的"是區(qū)分"借錢不還"詐騙罪與普通民間借貸的重要標(biāo)準(zhǔn),在認(rèn)定此類詐騙罪時(shí),不能簡單地認(rèn)為只要到期不還就是詐騙。實(shí)際生活中到期不還的情況時(shí)有發(fā)生,原因也很復(fù)雜,如有的人因?yàn)榧依锍霈F(xiàn)變故、自然災(zāi)害、不可抗力或者經(jīng)營不善、市場行情變動(dòng)而無力償還,這種情況就不能認(rèn)定行為人有非法占有的目的,在處理具體案件時(shí),要嚴(yán)格區(qū)分兩者的區(qū)別,防止將債務(wù)糾紛作為犯罪處理。
[Abstract]:"taking illegal possession as the purpose" is an important standard to distinguish the crime of "borrowing money and not paying back" from ordinary folk borrowing. In determining this kind of crime of fraud, we can not simply think that as long as the maturity is not returned, it can not be considered as fraud. In real life, non-payment of due dates occurs from time to time, for the reasons are also very complicated. For example, some people are unable to repay because of changes in their homes, natural disasters, force majeure or poor management, and market changes. This kind of situation can not confirm that the actor has the purpose of illegal possession. When dealing with specific cases, we should strictly distinguish the difference between the two, and prevent the debt dispute from being treated as a crime.
