【摘要】：人類的生存與發(fā)展離不開自然資源的保護(hù)與支持,其自然資源不僅包括基本的植被資源和動(dòng)物資源,亦包括土壤資源、空氣以及水資源等。在20世紀(jì),隨著科學(xué)技術(shù)的持續(xù)進(jìn)步以及經(jīng)濟(jì)高速發(fā)展,人類規(guī)模持續(xù)擴(kuò)大,并且生活方式也出現(xiàn)顯著變化,不管是經(jīng)濟(jì)發(fā)達(dá)的資本主義國(guó)家,還是經(jīng)濟(jì)欠發(fā)達(dá)的發(fā)展中國(guó)家,對(duì)資源的需求日益增多,這不僅使得自然資源顯著減少,并且嚴(yán)重影響了生物多樣性。與此同時(shí),外來物種的入侵不僅造成了生物多樣性的喪失,亦加劇了生態(tài)安全問題。正因?yàn)槿绱?20世紀(jì)50年代以來,國(guó)際社會(huì)開始重視外來物種入侵問題。2004年5月22日,“生物多樣性與外來入侵物種管理”被聯(lián)合國(guó)大會(huì)確定為新世紀(jì)第一個(gè)國(guó)際生物多樣性日的主題,自此外來物種入侵問題開始獲得各國(guó)廣泛關(guān)注。我國(guó)面臨著嚴(yán)重的外來物種入侵問題,不過這一問題并未獲得充分關(guān)注,防治外來物種入侵的專門立法也沒有提上議事日程,更缺乏與之相對(duì)應(yīng)的刑法規(guī)制措施。這是當(dāng)前我國(guó)生態(tài)領(lǐng)域立法亟待解決的重大問題,迫切需要法學(xué)界同仁深入探討,以更有效地維護(hù)我國(guó)的生物多樣性和生態(tài)安全。
[Abstract]:The survival and development of human beings can not be separated from the protection and support of natural resources. Its natural resources include not only basic vegetation and animal resources, but also soil resources, air and water resources. In twentieth Century, with the continuous progress of science and technology and the rapid economic development, the scale of human beings continued to expand and the way of life appeared. Significant changes have been made in both economically developed capitalist and underdeveloped developing countries, increasing the demand for resources, which not only reduces the natural resources significantly, but also seriously affects biodiversity. At the same time, the invasion of exotic species has not only caused the loss of biodiversity, but also aggravated the ecological security. Because of this, since 1950s, the international community has begun to pay attention to the invasion of alien species in May 22nd.2004. "Biodiversity and invasive species management" was identified by the United Nations General Assembly as the first international day of biodiversity in the new century. Our country is facing a serious problem of alien species invasion, but this problem has not been fully concerned. The special legislation to prevent and control foreign species invasion has not been put on the agenda, and it lacks the corresponding criminal regulation measures. It is an urgent problem to be solved in the current ecological field legislation in China, and it is urgently needed in the legal field. Benevolence is deeply explored in order to safeguard biodiversity and ecological security in China more effectively.
