拒不支付勞動(dòng)報(bào)酬罪探析

【摘要】:當(dāng)前國(guó)家高度重視保障勞動(dòng)報(bào)酬支付工作,在《刑法修正案(八)》增設(shè)了拒不支付勞動(dòng)報(bào)酬罪之后,最高人民法院又發(fā)布了《關(guān)于審理拒不支付勞動(dòng)報(bào)酬刑事案件適用法律若干問(wèn)題的解釋》,用于在司法實(shí)踐中正確適用拒不支付勞動(dòng)報(bào)酬罪。雖然解決拖欠勞動(dòng)者勞動(dòng)報(bào)酬的工作取得了積極進(jìn)展,但是拖欠勞動(dòng)報(bào)酬案件數(shù)量依然比較大,解決拖欠勞動(dòng)報(bào)酬的問(wèn)題仍是一件任重而道遠(yuǎn)的任務(wù)。就目前現(xiàn)狀來(lái)看,在處理此類(lèi)問(wèn)題中由法院處理的拒不支付勞動(dòng)報(bào)酬案件所占比重明顯較低,拒不支付勞動(dòng)報(bào)酬罪在司法實(shí)踐中也有很多實(shí)務(wù)問(wèn)題存在爭(zhēng)議。 本文結(jié)合《刑法修正案(八)》和最高法發(fā)布的《解釋》,從拒不支付勞動(dòng)報(bào)酬罪的立法本意入手,對(duì)本罪的犯罪構(gòu)成作簡(jiǎn)要陳述,,重點(diǎn)分析本罪在適用過(guò)程中出現(xiàn)的各類(lèi)問(wèn)題,為立法完善和司法實(shí)踐提出一些建議。主要分為以下四個(gè)部分: 第一部分是對(duì)拒不支付勞動(dòng)報(bào)酬罪的概述,第一節(jié)簡(jiǎn)要介紹本罪的立法背景,第二節(jié)簡(jiǎn)要介紹本罪在司法實(shí)踐中遇到的一些困惑,主要包括學(xué)界對(duì)設(shè)立本罪名是否合適的學(xué)術(shù)爭(zhēng)議和本罪在司法實(shí)踐中的現(xiàn)狀。 第二部分對(duì)本罪的構(gòu)成特征進(jìn)行法理分析并簡(jiǎn)要論述。在闡述本罪犯罪構(gòu)成要件的同時(shí),分析了一些比較有爭(zhēng)議的學(xué)術(shù)觀點(diǎn)。對(duì)本罪主觀方面是否需要表現(xiàn)為“惡意”、雙重客體、“經(jīng)責(zé)令支付仍不支付”的內(nèi)涵等學(xué)界爭(zhēng)議提出了筆者的觀點(diǎn)。 第三部分對(duì)拒不支付勞動(dòng)報(bào)酬罪在司法適用中的實(shí)務(wù)問(wèn)題展開(kāi)討論,第一節(jié)主要分析本罪在法律適用中遇到的問(wèn)題,分別從事實(shí)勞動(dòng)關(guān)系、普通民事合同關(guān)系和非法用工三個(gè)角度展開(kāi)討論;第二節(jié)分析在用人單位延遲、克扣支付勞動(dòng)報(bào)酬的情形下本罪的入罪標(biāo)準(zhǔn);第三節(jié)采用比較的方法對(duì)本罪與侵占罪、詐騙罪、拒不履行判決、裁定罪的區(qū)別分別進(jìn)行闡述。 第四部分對(duì)拒不支付勞動(dòng)報(bào)酬罪的刑罰裁量的內(nèi)容展開(kāi)分析和討論,筆者對(duì)寬嚴(yán)相濟(jì)的刑事政策下本罪刑罰裁量、法定量刑情節(jié)和酌定量刑情節(jié)的適用問(wèn)題進(jìn)行了分析,并對(duì)拒不支付勞動(dòng)報(bào)酬罪適用公訴案件的當(dāng)事人和解程序作出了一定構(gòu)想。
[Abstract]:At present, the state attaches great importance to the work of safeguarding the payment of labor remuneration. After the addition of the crime of refusing to pay the remuneration for work in the Criminal Law Amendment (8), The Supreme people's Court has also issued an explanation on the application of the law in criminal cases of non-payment of labor remuneration, which is used to correctly apply the crime of refusing to pay labor remuneration in judicial practice. Although positive progress has been made in solving the problem of unpaid labor remuneration, the number of cases of unpaid remuneration is still relatively large, and solving the problem of unpaid remuneration is still a long task. As far as the present situation is concerned, the proportion of cases of non-payment of labor remuneration handled by the court is obviously low, and the crime of refusing to pay labor remuneration also has many practical problems in judicial practice. Combined with the Criminal Law Amendment (8) and the interpretation issued by the Supreme Law, this paper, starting with the legislative intent of the crime of refusing to pay the remuneration for labor, makes a brief statement on the constitution of the crime, and focuses on the analysis of various problems arising in the course of application of the crime. Some suggestions are put forward for legislative perfection and judicial practice. It is divided into the following four parts: The first part is an overview of the crime of refusing to pay the remuneration for labor. The first section briefly introduces the legislative background of the crime, the second section briefly introduces some puzzles encountered in the judicial practice. It mainly includes academic controversy about the appropriateness of establishing this crime and the present situation of this crime in judicial practice. The second part analyzes the constitution of this crime and discusses it briefly. At the same time, it analyzes some controversial academic viewpoints. The author puts forward the author's viewpoint on whether the subjective aspect of this crime should be manifested as "malice", "double object", "ordered payment still not to pay" and so on. The third part discusses the practical problems in the judicial application of the crime of refusing to pay labor remuneration. The first section mainly analyzes the problems encountered in the application of the law, respectively from the facts of labor relations. General civil contract relationship and illegal employment are discussed from three angles: the second section analyzes the standard of incrimination of this crime under the circumstances of employer delay and withholding of payment of labor remuneration; the third section uses comparative methods to analyze the crime, embezzlement, fraud, etc. If you refuse to fulfill the judgment, the distinction between the judgment and the judgment shall be explained separately. The fourth part analyzes and discusses the content of penalty discretion of the crime of refusing to pay labor remuneration. The author analyzes the application of penalty discretion, statutory circumstances of sentencing and discretionary circumstances of sentencing under the criminal policy of combining leniency and severity. The conciliatory procedure of the parties in the public prosecution case is also proposed.
