【摘要】：幫助恐怖活動罪是我國《刑法修正案(九)》將原《刑法》第一百二十條之一的資助恐怖活動罪罪狀進行修改完善后的新罪名。本文以此個罪作為研究對象,并結(jié)合新近出臺的《反恐怖主義法》,運用刑法基本理論進行分析,以達到在理論和司法實踐上對該罪的正確把握。本文首先從“恐怖主義”的概念入手,深入解讀了“恐怖主義”一詞的內(nèi)涵、由來、特征及恐怖活動的基本概念,明析了幫助恐怖活動罪的概念界定,比較了關于幫助恐怖活動類犯罪在國際、國內(nèi)立法沿革,從橫向上厘清了關于資助、恐怖行為等相關術語的內(nèi)涵,從縱向上最大程度地對幫助對象進行層層分析,力求全方位、立體化的將幫助恐怖活動犯罪置于刑法法理之下。其次,本文著重梳理了幫助恐怖活動罪的犯罪構(gòu)成,提出了其客體是包含公共安全、國家安全等等在內(nèi)的復雜客體;客觀方面是通過為恐怖活動組織或者實施恐怖活動的個人籌集、提供經(jīng)費、物資、資源、信息等行為,為恐怖活動組織、實施恐怖活動或者恐怖活動培訓招募、運送人員的行為;主體是一般主體,既包括單位也包括自然人,并深入探討了國家機關和國家能否成為本罪主體問題;主觀方面,提出本罪只能是故意,直接故意且涵蓋了間接故意,過失是不能構(gòu)成本罪的。最后,本文結(jié)合相關案例,重點分析了本罪預備階段、既遂與未遂、中止以及罪數(shù)形態(tài),同時分析其與資助危害國家安全犯罪活動罪、洗錢罪及包庇、縱容黑社會性質(zhì)組織罪的聯(lián)系與區(qū)別,從而進一步地區(qū)分、認識本罪。
[Abstract]:The crime of aiding terrorist activities is a new crime after modifying and perfecting the crime of financing terrorist activities, which is one of the original Article 120 of the Criminal Law. This article regards this crime as the object of study. Combined with the newly issued Anti-Terrorism Law, this paper analyzes the crime by using the basic theory of criminal law, in order to get a correct grasp of the crime in theory and judicial practice. First, this paper starts with the concept of "terrorism". This paper deeply interprets the connotation, origin, characteristics and basic concepts of the term "terrorism", analyzes the definition of the crime of aiding terrorist activities, and compares the evolution of international and domestic legislation on the crime of aiding terrorist activities. Horizontally, it clarifies the connotation of related terms such as financing, terrorist acts, and so on, and makes a layer by layer analysis of the object of assistance to the greatest extent vertically, in an all-round and three-dimensional way, putting the crime of aiding terrorist activities under the legal principle of criminal law. Secondly, This paper focuses on the criminal constitution of the crime of helping terrorist activities, and points out that its object is a complex object, including public safety, national security, etc. The objective aspect is to collect money for individuals who organize or carry out terrorist activities. The act of providing funds, materials, resources, information, etc., to organize terrorist activities, to carry out terrorist activities, or to train, recruit, and transport personnel; the main body is the general subject, which includes both units and natural persons, It also discusses whether the state organs and the state can become the subject of the crime; subjectively, the author points out that the crime can only be intentional, direct intent and covers indirect intent, and negligence cannot constitute this crime. Finally, this article combines with relevant cases. The paper mainly analyzes the preparatory stage of this crime, including accomplished crime and attempted crime, suspension as well as the form of crime number, and at the same time analyzes the relationship and difference between the crime of financing criminal activities against national security, the crime of money laundering and concealment, and the crime of conniving at the crime of triad organization. In order to further distinguish, understand this crime.
