【摘要】：當前,飛速發(fā)展的互聯(lián)網信息技術全面融入社會生產生活、深刻改變著全球經濟格局、利益格局、安全格局,但同時也帶來了紛繁復雜的社會治理和法律問題。實踐中,"白帽子"(也稱"道德黑客")通過向一些互聯(lián)網平臺或者軟件制造商反饋、發(fā)布安全漏洞,以敦促其修復完善相關漏洞的行為時有發(fā)生。如何在法律層面界定"白帽子",對于"白帽子"挖掘漏洞過程中獲取的個人信息及商業(yè)數據如何加強保護等問題引起了普遍關注,司法實務中對上述問題的處理方式也不盡一致。鑒于此,本刊遴選典型案例,邀請法學專家和實務界人士就"白帽子"行為的司法認定問題進行深入研討。
[Abstract]:At present, the rapid development of Internet information technology is fully integrated into social production and life, profoundly changing the global economic pattern, the pattern of interests, and the pattern of security. But it also creates complex social governance and legal issues. In practice, "white hats" (also known as "moral hackers") issue security vulnerabilities by giving feedback to some Internet platforms or software makers. How to define "white hat" at the legal level and how to strengthen the protection of personal information and commercial data obtained during the process of "white hat" exploitation have aroused widespread concern, In view of this, the Journal selects typical cases and invites legal experts and practitioners to conduct in-depth study on the judicial determination of "White Hat" behavior.
