【摘要】：在輕刑化為主流的社會(huì)發(fā)展過程中,資格刑在限制或剝奪犯罪分子的再犯能力方面有其獨(dú)有優(yōu)勢(shì)。我們對(duì)資格刑進(jìn)行以下研究探討:資格刑的基礎(chǔ)概念、國(guó)外對(duì)資格刑的立法規(guī)定、我國(guó)資格刑發(fā)展現(xiàn)狀、對(duì)資格刑進(jìn)行完善。論文共有五個(gè)部分,合計(jì)約15000字。第一部分:引言。本部分主要探討的是對(duì)資格刑進(jìn)行研究的目的和相關(guān)意義,以及現(xiàn)在的研究現(xiàn)狀第二部分:資格刑基礎(chǔ)理論概述。本部分首先對(duì)研究資格刑的內(nèi)涵探討確認(rèn),通過比較不同學(xué)者的觀點(diǎn),我們認(rèn)為資格刑是以犯罪人的資格為剝奪內(nèi)容的。并對(duì)資格刑的特征進(jìn)行探析,了解資格刑的起源和演變,最后剖析資格刑的現(xiàn)實(shí)價(jià)值。第三部分:國(guó)外關(guān)于資格刑的法律規(guī)定。本部分先系統(tǒng)的介紹了國(guó)外資格刑的種類,然后分別介紹了德國(guó)、法國(guó)資格刑制度的觀點(diǎn)和有益于我國(guó)的學(xué)習(xí)之處。第四部分:我國(guó)資格刑的立法現(xiàn)狀及反思。介紹了我國(guó)現(xiàn)有法律規(guī)定的剝奪政治權(quán)利和驅(qū)逐出境,對(duì)我國(guó)刑罰體系外的準(zhǔn)資格刑規(guī)定進(jìn)行了介紹,然后分析了我國(guó)資格刑存在的問題及反思。第五部分:我國(guó)資格刑的立法完善。主要從兩方面進(jìn)行補(bǔ)足,即完善資格刑自身體系和完善資格刑的適用制度。
[Abstract]:In the light punishment is the mainstream of the development process, the qualification penalty has its unique advantage in limiting or depriving the criminal recidivism ability. We carried out the following research: basic concepts of qualification penalty, qualification penalty, qualification penalty to the foreign legislative provisions of qualification penalty in our country development situation, to improve the qualification penalty. This thesis consists of five parts, a total of about 15000 words. The first part: introduction. This part mainly discusses is to study the purpose and significance of the qualification penalty, and the research status of second parts now: an overview of the basic theory of qualification penalty. The first part of the connotation of the qualification penalty of confirmation, by comparison the views of scholars, we believe that the qualifications punishment is to offenders eligible for deprivation of content. And the characteristics of the qualification penalty of understanding the origin and evolution of the qualification penalty, the final analysis of the realistic value of qualification penalty. The third part: on the foreign qualification punishment law. The first part introduces the system of type of foreign qualification penalty, and then introduced the Germany and France qualification penalty system views and are beneficial to our study. The fourth part: the current legislation of qualification penalty and reflection. This paper introduces China's current the law of the deprivation of political rights and deportation, quasi qualification penalty provisions of the penalty system in our country and abroad are introduced, and then analyzes the problems and reflection of qualification penalty in our country. The fifth part: the perfection of qualification punishment legislation. The main complement from two aspect, namely improving the qualification penalty system and its the suitable system of improving the qualification penalty.
