【摘要】：2013年全國檢察機關起訴的瀆職犯罪案件中，，80%左右的案件被法院判處緩刑或者免予刑事處罰，這也成為我國瀆職犯罪處罰上的一個“特色”，從現(xiàn)有的瀆職犯罪的處罰體系中反思，對于此類犯罪而言，如何避免法律的嚴肅性和權(quán)威性受到挑戰(zhàn)，而又能適應現(xiàn)實需要對此類犯罪進行更加合理的打擊。給筆者帶來深深的思考。因此，選擇將過失瀆職犯罪刑事處罰的轉(zhuǎn)化作為本文研究的論題，本文首先對過失瀆職犯罪處罰的現(xiàn)狀進行分析，找出存在的問題，最后提出了本文的觀點，將符合一定條件的過失瀆職犯罪，按照一定的原則和規(guī)則轉(zhuǎn)化到非刑罰處罰方法，提出多元化處罰方式的解決方案，為有效預防和準確懲罰此類犯罪提出借鑒。
[Abstract]:In 2013, about 80 percent of the cases of malfeasance prosecuted by procuratorial organs nationwide were suspended or exempted from criminal punishment, which has become a "feature" in the punishment of dereliction of duty in China, reflecting on the existing punishment system for dereliction of duty. For this kind of crime, how to avoid the challenge to the seriousness and authority of the law, and how to adapt to the actual need to carry out a more reasonable attack on this kind of crime. This paper chooses the transformation of criminal punishment for negligent dereliction of duty as the topic of this paper. Firstly, this paper analyzes the present situation of criminal punishment for negligent dereliction of duty, finds out the existing problems, and finally puts forward the viewpoint of this paper. The crime of negligence dereliction of duty, which meets certain conditions, is transformed into non-penalty method according to certain principles and rules, and the solution of diversified punishment is put forward, which can be used for reference to prevent and punish such crime effectively and accurately.
