【摘要】：我國《刑法修正案(九)》首次在貪污賄賂罪中設立了終身監(jiān)禁制度。從世界范圍來看,美國將終身監(jiān)禁的設立作為減少死刑的必要措施,而歐洲從一開始就否定了終身監(jiān)禁存在的合法地位。在國際法上,終身監(jiān)禁一直處于灰色地帶。在刑罰目的上,終身監(jiān)禁違背了改造和回歸社會的特殊預防目的,無明顯的一般預防功能。在具體的刑事執(zhí)行問題上,終身監(jiān)禁催生了罪犯的絕望心理,使得監(jiān)獄考核機制失效,加重了監(jiān)獄負擔。無論是從功利主義還是從人道主義的立場出發(fā),終身監(jiān)禁都不宜作為死刑的替代措施。
[Abstract]:China's Criminal Law Amendment (9) established the system of life imprisonment for the first time in the crime of embezzlement and bribery. From a worldwide perspective, the establishment of life imprisonment in the United States is regarded as a necessary measure to reduce the death penalty. From the beginning, Europe has denied the legal status of life imprisonment. In international law, life imprisonment has been in a grey area. In terms of penal purposes, life imprisonment violates the special preventive purpose of reforming and returning to society. There is no obvious general preventive function. On the specific issue of criminal execution, life imprisonment gives birth to the despair of criminals and makes the prison assessment mechanism ineffective. Both utilitarianism and humanitarianism make life imprisonment an alternative to the death penalty.
