【摘要】："社會(huì)治理刑罰化"是指刑罰權(quán)在社會(huì)治理過程中日益擴(kuò)張與加重的趨勢(shì)。"社會(huì)治理刑罰化"力圖通過刑事立法的明文宣示與刑罰執(zhí)行的嚴(yán)懲不貸,申彰威懾效應(yīng),貶抑違法惡徑,導(dǎo)引守法善行。然而,從邏輯而言,"社會(huì)治理刑罰化"預(yù)設(shè)公眾事先明晰刑法,然而其再行實(shí)施卻幾無可能,期望公眾面對(duì)決策完全理性,但實(shí)際上卻難如登天。從經(jīng)驗(yàn)而言,"社會(huì)治理刑罰化"高估刑罰威懾的心理強(qiáng)制作用,事實(shí)上內(nèi)心約束與道德控制才是克己守法的首要?jiǎng)恿Α膶?shí)踐而言,"社會(huì)治理刑罰化"催生監(jiān)禁人口率持續(xù)飆升,而犯罪率高居不下,其犯罪預(yù)防效果事與愿違。因此,社會(huì)轉(zhuǎn)型期,更須謹(jǐn)慎使用刑罰權(quán)而非恣意擴(kuò)張與加重。
[Abstract]:"penalty of social governance" refers to the increasing expansion and aggravation of penalty right in the process of social governance. However, from the logic point of view, "the punishment of social governance" presupposes the public to clarify the criminal law in advance, but it is almost impossible to implement it again, expecting the public to face the decision making completely rational. But in reality, it is difficult. From the experience, "social governance penalization" overestimates the psychological compulsion of penalty deterrence. As a matter of fact, inner restraint and moral control are the primary driving forces for self-discipline. In practice, the "punishment of social governance" has led to a continuous surge in the rate of incarceration and a high crime rate, which has the effect of crime prevention backfired. In the period of social transformation, it is necessary to use penalty power with caution rather than wanton expansion and aggravation.
