【摘要】：現(xiàn)代企業(yè)制度是隨著社會經(jīng)濟的飛速發(fā)展而建立起來的,其是一種典型的委托與代理關(guān)系,甚至可以直接解釋為一種契約關(guān)系。契約之下,任何人都會成為背棄的一方。因而,現(xiàn)代企業(yè)制度為高管侵害公司利益創(chuàng)造了便利條件。本文以高管侵害公司利益犯罪為中心,對茶葉公司高管侵害公司利益的犯罪種類進行了探析,并對其侵害行為的刑法控制措施進行了簡要概述。
[Abstract]:The modern enterprise system is established with the rapid development of social economy. It is a typical principal-agent relationship, which can even be directly interpreted as a contractual relationship. Under the contract, anyone will become a renegade party. The modern enterprise system has created convenient conditions for executives to infringe on the interests of the company. This paper focuses on the crime of infringing on the interests of the company by the executives of the tea company, and probes into the types of crimes that the executives of the tea companies infringe upon the interests of the companies. And the criminal law control measures of their violations are briefly summarized.
