【摘要】：網(wǎng)絡(luò)技術(shù)的革新給人類帶來了巨大便利,但同樣因為網(wǎng)絡(luò)的開放,也使得現(xiàn)代社會也面臨著之前從未面臨的挑戰(zhàn)。隨著技術(shù)的進(jìn)步,尤其是網(wǎng)絡(luò)時代的到來,我國侵犯著作權(quán)罪如何面對社會發(fā)展的新要求,將是一個長期的值得研究的問題。本文針對網(wǎng)絡(luò)環(huán)境下侵犯著作權(quán)罪所面臨的新挑戰(zhàn)展開討論,提出了立法中的一些不足,并就這些問題展開了論述。本文全篇共三章。在第一章中,本文大致介紹了著作權(quán)的一些理論,以及網(wǎng)絡(luò)空間中本罪顯現(xiàn)出來的一些新的特征,希望給予讀者一個對本罪大致的背景感知。在第二章中,本文主要介紹了我國著作權(quán)犯罪刑法立法現(xiàn)狀、存在的問題及原因,希望能夠全面的揭示我國立法中的不足。在第三章中,本文介紹了國際公約以及其他國家如何應(yīng)對網(wǎng)絡(luò)發(fā)展中新型侵犯著作權(quán)犯罪對立法的沖擊,希望對我國今后的著作權(quán)刑事保護(hù)有所啟發(fā),從中開辟立法的新路徑,并在之后結(jié)合域外立法與我國的立法、司法實踐,提出了一些在之后《刑法》修訂過程中無法回避的問題。針對這些問題,本文在第三章還提出了一些完善的建議與方向,希望能夠給讀者帶來一些啟發(fā)。
[Abstract]:The innovation of network technology has brought great convenience to human beings, but also because of the opening of the network, the modern society is also facing challenges that have never been faced before. With the progress of technology, especially the arrival of the network age, How to face the new requirements of the social development of the crime of infringing copyright in our country will be a long-term problem worthy of study. This paper discusses the new challenges faced by the crime of infringing on copyright in the network environment, and puts forward some deficiencies in the legislation. In the first chapter, the author introduces some theories of copyright and some new features of this crime in cyberspace. In the second chapter, this paper mainly introduces the current situation, problems and reasons of the criminal law of copyright crime in our country. In the third chapter, this paper introduces the international conventions and other countries how to deal with the impact of the new copyright infringement crime on the legislation in the network development. I hope it will enlighten our country for the criminal protection of copyright in the future, open up a new path of legislation, and then combine the extraterritorial legislation with the legislative and judicial practice of our country. Some questions that can not be avoided in the course of the later revision of the Criminal Law are put forward. In the third chapter, the author also puts forward some perfect suggestions and directions, hoping to bring some inspiration to the readers.
