【摘要】：理論和實踐中對非法處置危險廢物類污染環(huán)境罪中處置行為的認定存在分歧,導(dǎo)致了"同案不同判"現(xiàn)象的出現(xiàn)。明確污染環(huán)境罪的保護法益對此類罪犯罪構(gòu)成要件之處置行為認定具有指導(dǎo)意義。污染環(huán)境罪是一種包含嚴(yán)重危害可能性的實害犯,其所保護的法益為具有相對獨立性的環(huán)境本身。嚴(yán)重危害可能性是指對傳統(tǒng)法益存在嚴(yán)重危害可能性,對生態(tài)環(huán)境自身而言則指已經(jīng)發(fā)生環(huán)境污染。解讀"兩高"《關(guān)于辦理環(huán)境污染刑事案件適用法律若干問題的解釋》第1條第2項、第5項中的處置行為時,應(yīng)將實施于企業(yè)特定空間范圍內(nèi)的各種處理行為排除在外,否則,將不當(dāng)擴大污染環(huán)境罪的處罰范圍,并且有違罪刑法定原則。
[Abstract]:In theory and practice, there are differences in the determination of disposal behavior in the crime of illegal disposal of hazardous wastes, This has led to the appearance of the phenomenon of "different judgments in the same case". It is of guiding significance to determine the disposition of the constitutive elements of such crimes by making clear the benefits of the protection law of the crime of pollution of the environment. The crime of pollution of the environment is a kind of actual crime which contains the possibility of serious harm. The legal interests it protects are the relatively independent environment itself. The possibility of serious harm refers to the possibility of serious harm to traditional legal interests. For the ecological environment itself, it refers to the occurrence of environmental pollution. When interpreting the interpretation of some issues concerning the applicable Law in handling Criminal cases of Environmental pollution in the "two High levels", the disposal act in item 2 and item 5 of Article 1, It is necessary to exclude all kinds of actions which are carried out in the specific space of the enterprise, otherwise, the scope of punishment for the crime of polluting the environment will be expanded improperly, and it will violate the principle of legally prescribed punishment for a crime against a specified crime.
