【摘要】：我國刑法明確界定了組織、領(lǐng)導(dǎo)、參加恐怖組織罪的概念及犯罪構(gòu)成,有利于從司法適用角度懲處恐怖活動犯罪。但我國刑法并沒有明確恐怖活動犯罪的具體表現(xiàn)形式,在查處具有暴力恐怖性質(zhì)的犯罪活動時,刑法的缺位使得對于恐怖活動犯罪往往只能按照普通罪名加以定性處理,甚至還存在難于作為犯罪定性處理的情況,難以體現(xiàn)反恐怖活動的特殊性。因此,在刑法立法上有必要增設(shè)規(guī)定"宣揚、煽動恐怖活動罪"、"非法持有宣揚恐怖主義物品罪"、"拒絕提供恐怖活動證據(jù)罪"等新罪名,并增添規(guī)定相應(yīng)的財產(chǎn)刑以更加有效地防控恐怖活動犯罪。
[Abstract]:The criminal law of our country clearly defines the concept and constitution of the crime of organizing, leading and participating in terrorist organization, which is helpful to punish the crime of terrorist activity from the angle of judicial application. However, the criminal law of our country does not clearly define the concrete manifestation of the crime of terrorist activity. In the investigation and punishment of criminal activities of violent and terrorist nature, the absence of criminal law makes the crimes of terrorist activities often be treated qualitatively according to ordinary crimes, and there are even situations where it is difficult to deal with crimes qualitatively. It is difficult to reflect the particularity of anti-terrorist activities. Therefore, it is necessary to add some new crimes in the criminal law legislation, such as "propagating and inciting terrorist activities", "illegally possessing and propagating terrorist articles", "refusing to provide evidence for terrorist activities", and so on. And add the corresponding property penalty to prevent and control the crime of terrorist activities more effectively.
