【摘要】：鑒于我國(guó)社會(huì)發(fā)展的實(shí)際狀況，現(xiàn)行刑法增加規(guī)定了組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織罪。隨后最高人民法院、全國(guó)人大常委會(huì)又分別作出相應(yīng)的司法、立法解釋。這些舉措在打擊組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織犯罪過(guò)程中起到了不可估量的作用。然而，由于立法與實(shí)踐的銜接不夠等原因，目前我國(guó)有關(guān)組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織犯罪的法律規(guī)范仍然不太全面、精確。這些缺陷在理論及實(shí)踐中引起了不少困惑和爭(zhēng)議。本文主要對(duì)黑社會(huì)性質(zhì)組織的概念基本特征及該罪的認(rèn)定與立法完善展開(kāi)了論述，以求有助于司法實(shí)踐。本文分為三部分： 第一部分：主要對(duì)黑社會(huì)性質(zhì)組織的概念、基本特征及其與其他組織的區(qū)別進(jìn)行了理論上的分析，指出黑社會(huì)性質(zhì)組織的四個(gè)基本特征，即形式特征、組織特征、行為特征和經(jīng)濟(jì)實(shí)力特征。 第二部分：主要從組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織犯罪的構(gòu)成要件、該罪與非罪的界限、特殊情況下組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織犯罪的認(rèn)定及該罪與相近罪的區(qū)別、該罪的罪數(shù)形態(tài)等方面論述組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織犯罪的認(rèn)定問(wèn)題。 第三部分：主要對(duì)現(xiàn)行刑事法中組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織犯罪的立法進(jìn)行了中外比較并指出其缺陷，主要是：罪狀描述不嚴(yán)謹(jǐn)，越權(quán)解釋和違反罪刑法定原則，犯罪主體狹窄等。并在此基礎(chǔ)上提出相關(guān)立法建議：進(jìn)一步科學(xué)界定黑社會(huì)性質(zhì)組織的概念，增設(shè)單位作為組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織罪的犯罪主體；合理配置黑社會(huì)性質(zhì)組織犯罪“嚴(yán)而不厲”的刑罰結(jié)構(gòu)；設(shè)完備的財(cái)產(chǎn)刑制度，科學(xué)界定財(cái)產(chǎn)刑的數(shù)額、范圍、方式，，在打擊組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織罪的過(guò)程中，要注意保護(hù)公民合法財(cái)產(chǎn)權(quán)。
[Abstract]:In view of the actual situation of social development in our country, the current criminal law has added provisions for organizing, leading and participating in crimes of organized crime of a triad nature. Subsequently, the Supreme people's Court and the standing Committee of the National people's Congress made corresponding judicial decisions respectively. Legislative interpretation. These measures have played an inestimable role in the process of cracking down on the criminal activities of organizations, leaders and triad organizations. However, due to the lack of convergence between legislation and practice, at present, the relevant organizations and leaders in our country, The legal norms governing participation in organized crimes of a triad nature are still not very comprehensive. These defects have caused a lot of confusion and controversy in theory and practice. This paper mainly discusses the basic characteristics of the concept of the underworld organization, the identification of the crime and the perfection of the legislation. This paper is divided into three parts:. The first part mainly analyzes the concept, the basic characteristics and the differences between the underworld organizations and other organizations in theory, and points out the four basic characteristics of the underworld organizations, that is, the form characteristics, the organizational characteristics. Characteristics of behavior and economic strength. The second part: mainly from the organization, leadership, participation in the constitution of the organized crime, the boundary between the crime and non-crime, the special circumstances of the organization, leadership, participation in the triad nature of the organization crime and the difference between the crime and similar crimes. The third part: mainly carries on the Chinese and foreign comparison to the current criminal law in the organization, the leadership, participates in the underworld nature organization crime legislation and points out its flaw, mainly is: the crime description is not strict, ultra vires the authority to explain and violates the crime criminal law principle, On the basis of this, some legislative suggestions are put forward: further defining the concept of underworld organization scientifically, adding units as organization, leading and participating in the criminal subject of the crime of underworld organization; To rationally allocate the criminal penalty structure of "strict but not severe" organized crime of the underworld nature, to set up a complete system of property punishment, to scientifically define the amount, scope and manner of property punishment, and to take part in the process of cracking down on organization, leading and participating in the crime of organized crime of underworld nature, Attention should be paid to the protection of citizens' legitimate property rights.
