【摘要】：中國(guó)古代社會(huì)的法律對(duì)老弱婦幼廢疾等群體一直予以特殊優(yōu)待。在偵查、審訊、量刑以及行刑等各階段均體現(xiàn)著為這一群體"網(wǎng)開一面"的寬宥政策。我國(guó)古代對(duì)老弱婦幼廢疾者的刑事寬宥政策不僅在適用主體之范圍上不斷擴(kuò)充,且在實(shí)體法和程序法上皆有體現(xiàn)。中華傳統(tǒng)文化之傳承、對(duì)這一群體承受能力之考量以及對(duì)社會(huì)和諧愿景之追求促成了古代刑事寬宥政策的實(shí)施。我國(guó)古代刑事寬宥政策與當(dāng)代刑事政策及法律體系有著相通之處,其部分制度和措施值得當(dāng)代法律借鑒。當(dāng)代刑法體系將對(duì)這一群體的保護(hù)視為目的而非手段,顯然更為進(jìn)步。上述寬宥政策一方面昭示了古代倫理道德對(duì)司法制度的影響,另一方面則對(duì)我國(guó)新時(shí)期的司法改革有著參考價(jià)值。
[Abstract]:The laws of ancient Chinese society have always given special treatment to such groups as the old, the weak, the disabled and the disabled. They are investigating and interrogating. Each stage of sentencing and execution embodies the lenient policy for this group. In ancient China, the criminal forgiveness policy for the elderly and the weak women and the disabled is not only expanding in the scope of the subject. And both in substantive law and procedural law. The inheritance of traditional Chinese culture, The consideration of the tolerance of this group and the pursuit of the vision of social harmony contributed to the implementation of the ancient criminal pardon policy. The ancient criminal pardon policy of our country has something in common with the contemporary criminal policy and legal system. Some of its systems and measures are worthy of reference by contemporary law. The protection of this group is regarded by the contemporary criminal law system as an end rather than a means, which is obviously more progressive. On the one hand, the above policy of forgiveness demonstrates the influence of ancient ethics and morality on the judicial system. On the other hand, it has reference value to the judicial reform in the new period of our country.
