【摘要】：正如何構(gòu)建刑事風(fēng)險(xiǎn)防控體系,因應(yīng)當(dāng)前高發(fā)的企業(yè)(家)犯罪現(xiàn)象和復(fù)雜的企業(yè)(家)犯罪成因?筆者認(rèn)為,法典索引式的企業(yè)刑事風(fēng)險(xiǎn)控制,缺乏現(xiàn)實(shí)操作性,與企業(yè)追求利潤的商業(yè)邏輯存在根本性沖突,實(shí)際效果極為有限。企業(yè)(家)刑事風(fēng)控,必須審時(shí)度勢、重點(diǎn)突出,不可草木皆兵、面面俱到。簡略而言,企業(yè)(家)刑事風(fēng)控實(shí)務(wù)必須注意以下重點(diǎn)面向。風(fēng)控點(diǎn)一:高危人群重點(diǎn)關(guān)照企業(yè)(家)刑事風(fēng)險(xiǎn)控制的重點(diǎn)關(guān)照對象是企業(yè)領(lǐng)導(dǎo)層,尤其是"一把手"的風(fēng)險(xiǎn)行為。
[Abstract]:How to build a criminal risk prevention and control system to cope with the current high incidence of enterprise (home) crime phenomenon and complex enterprise (home) crime causes? The author thinks that the criminal risk control of enterprise based on the code index lacks the practical operation, and there is a fundamental conflict with the business logic of the enterprise in pursuit of profit, and the actual effect is extremely limited. Focus, not all the trees and grass, everything. In a nutshell, Enterprises (home) criminal risk control practice must pay attention to the following key aspects. Risk control point one: high-risk groups focus on the criminal risk control of enterprises (home) focus on the object of concern is the enterprise leadership, especially the "number one" risk behavior.
