【摘要】：經(jīng)過多年的專項(xiàng)嚴(yán)打活動(dòng),我國拐賣兒童犯罪的特點(diǎn)發(fā)生了較大變化,以拐騙等常見手段實(shí)施的拐賣兒童犯罪明顯下降,父母出賣親生子女的犯罪上升。通過對(duì)公開的裁判文書和媒體報(bào)道案例的分析發(fā)現(xiàn):這類犯罪團(tuán)伙作案多,且經(jīng)常以網(wǎng)絡(luò)為媒介;出賣子女者多數(shù)文化程度較低;被出賣兒童以1歲以下嬰兒為主;這種監(jiān)護(hù)侵害行為較難被發(fā)現(xiàn),解救后對(duì)兒童造成二次傷害。此類犯罪形成的原因包括賣方貪利、買方強(qiáng)烈需求、中介拉攏等。防治此類犯罪需要加大宣傳教育和打擊力度,規(guī)范民間送養(yǎng)和收養(yǎng)行為。同時(shí),為了科學(xué)定罪量刑,還需完善立法和司法。
[Abstract]:After many years of special crackdown activities, the characteristics of the crime of child abduction and trafficking in China have changed greatly, and the crime of trafficking in children committed by common means such as abduction has dropped markedly. The crime of parents selling their biological children is on the rise. Through the analysis of the public adjudication documents and the cases reported by the media, it is found that such criminal groups commit many crimes, and often use the network as the medium, and most of the children who sell their children have a low level of education; Children who were sold out were mainly infants under 1 years of age; this kind of guardianship violation was more difficult to find and caused secondary harm to children after rescue. The causes of such crimes included the seller's greed and the buyer's strong demand. The prevention and cure of this kind of crime need to strengthen propaganda and education and crack down and standardize the folk feeding and adopting behavior. At the same time, in order to scientifically convict and sentence, it is necessary to perfect the legislation and judicature.
