【摘要】：通過對我國內(nèi)地最近20多年來發(fā)生的126起恐怖襲擊案件數(shù)據(jù)的比較分析可以發(fā)現(xiàn),我國恐怖主義犯罪出現(xiàn)了威脅加劇、組織形態(tài)異化、隱蔽性提升、手段翻新和對象轉(zhuǎn)向的新趨勢,而面對恐怖主義犯罪的"網(wǎng)絡化轉(zhuǎn)型",傳統(tǒng)的恐怖主義犯罪罪名體系已全面滯后。通過對尋釁滋事罪作擴張解釋和對共同犯罪理論進行更新,并在《中華人民共和國刑法修正案(九)》的基礎上增設實施恐怖襲擊罪和協(xié)助恐怖活動罪,是我國在信息時代實現(xiàn)有效制裁和預防恐怖主義犯罪目標的最佳對策。
[Abstract]:Through the comparative analysis of 126 terrorist attack cases in the mainland of China in the past 20 years or more, we can find that the terrorist crimes in China have increased threat, dissimilated organizational form, and enhanced concealment. In the face of the "network transformation" of terrorist crime, the traditional criminal criminal system of terrorism has completely lagged behind. By expanding the explanation of the crime of provoking and causing trouble and updating the theory of joint crime, On the basis of the Criminal Law Amendment (9) of the people's Republic of China, the crime of terrorist attack and the crime of assisting terrorist activities are added, which is the best countermeasure for our country to realize the goal of effective sanction and prevention of terrorist crimes in the information age.
