【摘要】：隨著互聯(lián)網(wǎng)的不斷發(fā)展,人們行使言論自由權(quán)利的空間越來越廣,方式越來越多,言論自由作為人的一項基本權(quán)利,在互聯(lián)網(wǎng)時代得到了更為充分的保障。然而,互聯(lián)網(wǎng)是一把雙刃劍,在充分保障人們自由發(fā)表言論的同時,也使網(wǎng)絡(luò)謠言成倍增長。網(wǎng)絡(luò)謠言的泛濫給國家、社會及個人帶來了極大的危害,用法律的方式為言論自由和網(wǎng)絡(luò)謠言劃一條界線,用刑法的手段有效保障網(wǎng)絡(luò)言論自由和打擊網(wǎng)絡(luò)謠言已是刻不容緩。因此,本文從三個部分對進(jìn)一步完善網(wǎng)絡(luò)謠言的刑法控制進(jìn)行深入探討。第一部分主要從國內(nèi)外的歷史及研究情況梳理“謠言”和“網(wǎng)絡(luò)謠言”的定義,大膽總結(jié)網(wǎng)絡(luò)謠言的法律定義,分析了網(wǎng)絡(luò)謠言的顯著特點,并從法律角度對網(wǎng)絡(luò)謠言進(jìn)行分類,進(jìn)而對網(wǎng)絡(luò)謠言刑法控制的合法性問題進(jìn)行探討。第二部分主要是介紹了大陸法系國家德國、韓國以及英美法系國家美國、新加坡在網(wǎng)絡(luò)謠言法律控制實踐中的成功經(jīng)驗,通過對比國內(nèi)外網(wǎng)絡(luò)謠言的法律控制情況,分析我國網(wǎng)絡(luò)謠言在刑法控制過程中立法、執(zhí)法、司法等方面存在的問題。第三部分是在前文論述的基礎(chǔ)上,結(jié)合網(wǎng)絡(luò)謠言的特點,針對當(dāng)前刑法控制存在的問題,從完善刑事立法、完善刑種配置和刑期、完善偵察環(huán)節(jié)的操作程序、完善訴訟環(huán)節(jié)的操作程序等四個方面提出了意見建議。目的是在刑法框架下構(gòu)建起一套行之有效的網(wǎng)絡(luò)謠言控制體系。
[Abstract]:With the continuous development of the Internet, people exercise the right to freedom of speech more and more space, more and more ways, freedom of speech as a basic right of human beings, in the Internet era has been more fully protected. The Internet is a double-edged sword. While fully guaranteeing people's freedom of speech, it also multiplies the number of Internet rumors. The proliferation of Internet rumors has brought great harm to the country, society and individuals. It is urgent to draw a line between freedom of speech and online rumors by means of the law, and to effectively guarantee the freedom of speech on the Internet and to crack down on online rumors by means of criminal law. This paper probes into the further improvement of the criminal law control of network rumor from three parts. The first part mainly combs the definition of "rumor" and "network rumor" from the history and research situation at home and abroad. This paper sums up the legal definition of online rumor, analyzes the prominent characteristics of it, and classifies it from the legal point of view. The second part mainly introduces the successful experience of the civil law countries Germany, South Korea, the United States of America and Singapore in the practice of the legal control of online rumors. By comparing the legal control situation of network rumor at home and abroad, this paper analyzes the problems existing in legislation, law enforcement and judicature in the criminal law control process of network rumor in our country. The third part is based on the previous discussion and combined with the characteristics of network rumor. In view of the problems existing in the control of the current criminal law, from perfecting the criminal legislation, perfecting the disposition and sentence of the punishment, perfecting the operation procedure of the reconnaissance link, In order to construct an effective network rumor control system under the framework of criminal law, the author puts forward four suggestions on how to improve the procedure of litigation.
