【摘要】：隨著經(jīng)隨著經(jīng)濟的發(fā)展,環(huán)境犯罪越來越引起社會的重視。我國97刑法對環(huán)境犯罪作出了規(guī)定。但在其刑事責任承擔方面存在著某些不足之處。本文首先從環(huán)境犯罪的特征入手。因為刑事責任是對犯罪行為的反映,只有在弄清楚環(huán)境犯罪特征的基礎之上,才能設定有針對性的刑事責任承擔方式,也才能夠針對我國立法不足之處提出建設性的意見。因為是涉及到環(huán)境犯罪刑事責任承擔的問題,刑事責任的基本知識自然成為應該介紹的重點內(nèi)容。在這兩方面基礎理論之上,本文第二章主要論述了外國環(huán)境刑事立法的共性特征、發(fā)展歷程以及環(huán)境犯罪刑事責任承擔的優(yōu)點和可取之處。我國環(huán)境犯罪刑事責任立法既有可取之處,也存在某些不足的地方。在外國立法經(jīng)驗和本國法律實際情況的前提下,提出了針對我國環(huán)境犯罪刑事責任完善的意見。
[Abstract]:With the development of economy, Environmental crime attracts more and more attention of the society. Our country's 97 criminal law provides for environmental crime. However, there are some deficiencies in its criminal liability. Firstly, this paper starts with the characteristics of environmental crime. Responsibility is a reflection of a criminal act, Only on the basis of making clear the characteristics of environmental crime, can we set up a targeted way to assume criminal responsibility. It is also possible to put forward constructive suggestions on the deficiencies of our legislation, because it is a matter of criminal responsibility for environmental crimes. The basic knowledge of criminal responsibility naturally becomes the key content that should be introduced. On the basis of these two basic theories, the second chapter of this paper mainly discusses the common features of foreign environmental criminal legislation. The course of development and the advantages and advantages of the criminal liability for environmental crimes. The legislation of criminal liability for environmental crimes in our country has both advantages and disadvantages. On the premise of foreign legislative experience and the actual situation of domestic law, China's environmental crime criminal liability legislation has its advantages and disadvantages. The author puts forward some suggestions on the perfection of criminal responsibility for environmental crimes in China.
