【摘要】：本文主要采用比較研究的方法對有組織犯罪進行剖析。在近幾十年的時間里,國際上關(guān)于有組織犯罪的學(xué)說一直存在著分歧,無法形成統(tǒng)一的意見。我國學(xué)者基本認同從犯罪學(xué)、刑法學(xué)界定有組織犯罪的概念是有差異的,且其都具有功效,因而提倡有組織犯罪概念的二元論,至于其它兩個方面的問題至今尚未達成共識；大多數(shù)學(xué)者認為有組織犯罪包括團伙犯罪、集團犯罪和黑社會(性質(zhì))犯罪,只有少部分學(xué)者認為有組織犯罪就是典型的黑社會犯罪。近年來,有組織犯罪呈現(xiàn)出諸多新情況,諸如依托網(wǎng)絡(luò)演化出的新型有組織犯罪、企業(yè)化趨勢明顯,組織更加嚴密、政治滲透進一步加強、跨國有組織犯罪案件增多、跨國有組織犯罪增多等。我國有組織犯罪存在發(fā)展迅速、再生能力強、存續(xù)時間短,有組織犯罪的各種發(fā)展形態(tài)交互衍生等本土性特征。我國懲治有組織犯罪的實踐中存在認定有組織犯罪較為困難、對有組織犯罪的起訴較為困難、“一陣風(fēng)”式執(zhí)法弊端盡顯、我國警力嚴重不足等困境。造成我國懲治有組織犯罪實踐困境的原因有立法滯后、沒有針對有組織犯罪的立法,對有組織犯罪的文化認識片面、當前“打黑除惡”刑事政策遭遇阻礙等方面。世界各國應(yīng)對有組織犯罪的措施對我國有所啟迪。意大利的《黑手黨悔過法》,美國的《反組織犯罪侵害合法組織法》,德國廣泛使用的秘密偵查手段,法國設(shè)立的跨大區(qū)專門法院(JIRS)和共同調(diào)查組都是可資借鑒的樣本,打擊有組織犯罪事件困境的對策包括：建立具有強大偵查能力、更強信息整合能力和完善的證人保護能力防控有組織犯罪的專門機構(gòu),制定針對有組織犯罪的刑法,建立針對有組織犯罪的特別訴訟制度,構(gòu)建良好的社會文化環(huán)境。
[Abstract]:This paper mainly uses the method of comparative study to analyze the organized crime. In recent decades, there have been differences on the theory of organized crime in the world. Our scholars basically agree that there are differences in the definition of organized crime from the perspective of criminology and criminal jurisprudence, and both of them have effects, so they advocate the dualism of the concept of organized crime. As for the other two issues, there is no consensus to date; Most scholars believe that organized crime includes gang crime, group crime and underworld crime. Only a few scholars believe that organized crime is a typical gangster crime. Organized crime presents many new situations, such as the evolution of a new type of organized crime based on the network, the trend of enterprise is obvious, the organization is more rigorous, the political infiltration is further strengthened, and the number of transnational organized crime cases is increasing. The existence of organized crime in China has developed rapidly, has strong regenerative ability and short survival time. In the practice of punishing organized crime, it is difficult to identify organized crime, and it is more difficult to prosecute organized crime. The malpractice of "gust of wind" type law enforcement, serious shortage of police force in our country, and so on. The reasons for the practical dilemma of punishing organized crime in our country are the lagging legislation, there is no legislation for organized crime. The cultural understanding of organized crime is one-sided, and the current criminal policy of "cracking down on crime and eliminating evil" has encountered obstacles. The measures taken by various countries to deal with organized crime have enlighten our country. Italy's "Mafia repentance Law". The United States "Anti-Organizing Crime against the legal Organization Act", Germany's widely used secret investigative techniques, France set up a special cross-regional court (JIRS) and the joint investigation team are all examples to be used for reference. The countermeasures to combat the plight of organized crime include the establishment of specialized agencies with strong investigative capability, stronger information integration ability and perfect witness protection ability to prevent and control organized crime. Make criminal law against organized crime, set up special lawsuit system against organized crime, and construct good social and cultural environment.
