【摘要】：黑社會(huì)性質(zhì)組織犯罪給整個(gè)社會(huì)帶來(lái)了巨大的危害性,不僅是當(dāng)前國(guó)際社會(huì),也是我國(guó)社會(huì)治安面臨的嚴(yán)峻挑戰(zhàn)。中國(guó)地域遼闊、經(jīng)濟(jì)發(fā)展?fàn)顩r存在著很大的差異。每個(gè)地域有著獨(dú)特的風(fēng)土人情、民俗習(xí)慣、文化理念等。因此,將目光轉(zhuǎn)向?qū)嵺`,研究Q市的黑社會(huì)性質(zhì)組織犯罪,通過(guò)數(shù)據(jù)分析,研究和總結(jié)Q市黑社會(huì)性質(zhì)組織犯罪的特點(diǎn),探討原因,才能提出針對(duì)性的防治措施。 此次研究選取的是“Q市黑社會(huì)性質(zhì)組織犯罪”的相關(guān)案件,即Q市司法機(jī)關(guān)已審理完畢的黑社會(huì)性質(zhì)組織犯罪案件,從中選取了具有代表性、權(quán)威性、時(shí)效性的樣本,并根據(jù)研究需求設(shè)定了各項(xiàng)調(diào)查指標(biāo)。 從刑事判決文書(shū)中提取和錄入相關(guān)數(shù)據(jù),運(yùn)用SPSS軟件進(jìn)行分析,用數(shù)據(jù)來(lái)表明Q市黑社會(huì)性質(zhì)組織犯罪所具有的組織特征、行為特征、經(jīng)濟(jì)特征和非法控制性特征。Q市黑社會(huì)性質(zhì)組織其成員文化程度,集中在小學(xué)和初中,主要來(lái)自社會(huì)閑散人員和農(nóng)民；制約和控制組織成員的主要方式是感情聯(lián)絡(luò)、“家規(guī)”以及公司制度；獲取經(jīng)濟(jì)利潤(rùn)的途徑是在公司掩護(hù)下進(jìn)行非法經(jīng)營(yíng)活動(dòng),最終的目標(biāo)也是牟取巨額的經(jīng)濟(jì)利益；主要采取的手段有,暴力威脅、依靠保護(hù)和公司企業(yè),在Q市的一定區(qū)域或是行業(yè)內(nèi),形成非法控制,或造成重大影響,嚴(yán)重動(dòng)搖了當(dāng)?shù)氐慕?jīng)濟(jì)、政治和社會(huì)生活基礎(chǔ)。 明析了Q市黑社會(huì)性質(zhì)組織的特征,根據(jù)黑社會(huì)性質(zhì)自組織原因論的基本原理,深入分析Q市黑社會(huì)性質(zhì)組織犯罪的社會(huì)根源、驅(qū)動(dòng)力、精神支柱、政治腐敗、社會(huì)控制力等原因。 最終,在深入分析Q市黑社會(huì)性質(zhì)組織犯罪的特征和原因的基礎(chǔ)上,采取社會(huì)、經(jīng)濟(jì)、文化和教育等其他對(duì)策,以達(dá)到控制和預(yù)防Q市黑社會(huì)性質(zhì)組織犯罪的目的,從而維護(hù)社會(huì)穩(wěn)定和諧發(fā)展。
[Abstract]:The organized crime of underworld nature has brought great harm to the whole society. It is not only the current international community, but also the severe challenge to the public security of our country. China has a vast territory. There are great differences in economic development. Each region has its unique customs, customs, cultural concepts and so on. Through the analysis of data, this paper studies and summarizes the characteristics and causes of the organized crime of the underworld nature in Q City, and then puts forward the corresponding preventive measures. This study selects the related cases of "Q city underworld organized crime", that is, Q City judicial organ has completed the trial of the crime of underworld nature organization crime, from which the representative and authoritative selection. Sample of timeliness, and according to the needs of the research set the various survey indicators. Extract and input the relevant data from the criminal judgment document, use the SPSS software to analyze, use the data to show the organization characteristic and behavior characteristic of the organized crime of the underworld nature of Q city. Economic characteristics and illegal controlling characteristics. Q city triad organizations whose members' education level is concentrated in primary schools and junior high schools, mainly from social idle personnel and farmers; The main ways to restrict and control the members of the organization are emotional contact, "family rules" and the company system; The way to obtain economic profits is to carry out illegal business activities under the cover of the company, and the ultimate goal is to obtain huge economic benefits. The main means used include the threat of violence, reliance on protection and corporate enterprises, the formation of illegal control in certain areas of Q City or within the industry, or its significant impact, which has seriously shaken the local economy. Basis of political and social life This paper analyzes the characteristics of the underworld organization in Q city, and analyzes the social origin, driving force and spiritual pillar of the organized crime of the underworld character in Q city according to the basic principle of the self-organizing reason theory of the underworld nature. Political corruption, social control and other reasons. Finally, on the basis of in-depth analysis of the characteristics and causes of organized crime in Q city, other countermeasures such as society, economy, culture and education are adopted. In order to control and prevent the crime of Q city, so as to maintain social stability and harmonious development.
