【摘要】：隨著法治進程的不斷推進，廢除死刑不僅僅是國際社會發(fā)展的趨勢，也是當(dāng)代中國構(gòu)建和諧社會，踐行科學(xué)發(fā)展觀的必然需求。死刑捍衛(wèi)者將“民眾不答應(yīng)”作為堅持死刑的一大理由。本文就是以此為出發(fā)點，消除死刑廢除需取得公眾同意這樣一種觀點；樹立另一種觀點：死刑立法受制于死刑政策，死刑存廢是由社會精英決定的。 本文綜合從國內(nèi)外死刑領(lǐng)域的歷史和現(xiàn)狀，通過分析美國、歐盟、香港的死刑去存廢情況，在文章的第四部分形成一個新觀點：無論是目前存在死刑的國家和地區(qū)還是廢除死刑的國家和地區(qū)，實際上都不是因為民眾的支持而存在或民眾的反對而廢除。死刑廢除有其復(fù)雜而深刻的政治、歷史、文化等因素，但本質(zhì)上都是一個國家的死刑政策和社會精英的作用。 從現(xiàn)實的角度來看，，民意對死刑的存廢確實具有影響作用，民眾對死刑支持率也比較高。但從客觀、理性的角度評價死刑民意卻具有的滯后性、非理性等缺點，嚴(yán)重限制了死刑民意成為支撐死刑的依據(jù)。因此本文最后一部分就針對死刑民意所具有的變化性的特征提出了相應(yīng)的民意引導(dǎo)措施，為死刑改革在民意方面明確方向。
[Abstract]:With the continuous advancement of the process of rule of law, abolishing the death penalty is not only the trend of international social development, but also the construction of a harmonious society in contemporary China. The necessity of practicing the scientific concept of development. The death penalty defenders regard "the public disallow" as a major reason to insist on the death penalty. This article takes this as the starting point to eliminate the death penalty abolition needs to obtain the public agreement such a kind of view; Establish another view: death penalty legislation is subject to death penalty policy, death penalty survival and abolition is determined by the social elite. This article synthetically from the domestic and foreign death penalty domain history and the present situation, through the analysis America, the European Union, the Hong Kong death penalty to save or abolish the situation. In the 4th part of the article formed a new point of view: whether the current existence of the death penalty countries and regions or abolitionist countries and regions. In fact, it is not abolished because of popular support or popular opposition. The abolition of the death penalty has its complex and profound political, historical, cultural and other factors. But it is essentially the death penalty policy of a country and the role of the social elite. From a realistic point of view, public opinion does have an impact on the existence and abolition of the death penalty, and the public support for the death penalty is also relatively high. But from an objective and rational point of view, the evaluation of public opinion on the death penalty has a lag. Irrationality and other shortcomings seriously limit the death penalty public opinion as the basis for supporting the death penalty. So the last part of this paper puts forward the corresponding public opinion guidance measures in view of the changing characteristics of the death penalty public opinion. Make clear the direction of public opinion for the death penalty reform.
