【摘要】：隨著互聯(lián)網(wǎng)全球覆蓋趨勢的發(fā)展,人們對網(wǎng)絡技術的便捷性、高效性、高速性的要求也愈來愈高。水漲船高,網(wǎng)絡技術在人們的需求下也呈現(xiàn)不斷更新發(fā)展的態(tài)勢。然而,事物的發(fā)展總有其兩面性,網(wǎng)絡技術的高速發(fā)展給我們帶來上網(wǎng)沖浪方便的同時,也被一些不法分子用來實施違法犯罪行為,造成了不可估量的危害后果。而法律的更新總是滯后于社會的發(fā)展,雖然立法具有預測機能,但預測的情況并不能窮盡現(xiàn)實發(fā)生的所有情況。本文筆者就網(wǎng)絡技術深度鏈接為研究對象,致力于探索深度鏈接技術引起的犯罪現(xiàn)象,尋找出刑法規(guī)制的路徑,以此為我國刑法立法獻出綿薄之力。本文共分為四大部分。第一部分主要是基礎知識奠基,首先明確鏈接是什么,深度鏈接又是什么,深度鏈接的分類及行為模式又是怎樣的,循序漸進,逐漸進入本文主旨性問題研究。深度鏈接是一種快捷的鏈接技術,是中立的技術,其具有高速搜索目標數(shù)據(jù)信息的功能,并且不會使用戶發(fā)現(xiàn)其原本所在的網(wǎng)頁甚至網(wǎng)站發(fā)生了跳轉,致使用戶產生錯覺,認為其獲得的網(wǎng)絡信息資源全部來源于設鏈網(wǎng)站。深度鏈接行為在某些情況下,會造成著作權侵權行為。第二部分從《刑法修正案(九)》入手,分析了網(wǎng)絡犯罪的立法現(xiàn)狀,以及在《刑法修正案(九)》頒布以前,我國面對網(wǎng)絡犯罪時無法可依的無奈�！缎谭ㄐ拚�(九)》針對網(wǎng)絡犯罪的新增條款,一定程度上解決了網(wǎng)絡犯罪無法可依的窘態(tài)。通過對深度鏈接的法律屬性分析,為明確下文探索違法設鏈行為入罪路徑提供了理論鋪墊。第三部分主要論述深度鏈接行為入罪的必要性,分別從應然和實然兩個角度進行了分析。在現(xiàn)今社會潮流下,網(wǎng)絡技術迅猛發(fā)展,不同的網(wǎng)絡使用者會賦予中立的網(wǎng)絡技術以不同的性質,使其產生截然相反的效果。當中立的網(wǎng)絡技術被用以合法正當?shù)男袨闀r,其便捷性大大提高了網(wǎng)絡用戶的工作效率,當被用以違法犯罪行為時,其帶來的損害結果也是極大的。因此,當深度鏈接技術被用以違法犯罪行為時,用刑法調整是再合適不過的。第四部分,筆者論述了兩條深度鏈接行為入罪的路徑。一是以幫助行為正犯化入罪,二是作為侵犯著作權罪的共犯入罪。該兩條路徑雖然不夠完善,但筆者意在拋磚引玉,希望能有更多的觀點來完善和彌補現(xiàn)有法律的不足。
[Abstract]:With the development of the global coverage of the Internet, the demand for the convenience, efficiency and high speed of the network technology is getting higher and higher. However, the development of things always has its two sides. The rapid development of network technology brings us the convenience of surfing the Internet at the same time. It is also used by some lawbreakers to commit illegal and criminal acts, causing incalculable harmful consequences. However, the updating of the law always lags behind the development of the society, although the legislation has the function of prediction. However, the predicted situation can not be exhausted in reality. The author of this paper focuses on the deep link of network technology as the research object, dedicated to explore the criminal phenomenon caused by the deep link technology, and find out the path of criminal law regulation. This paper is divided into four parts. The first part is the foundation of basic knowledge. First, it is clear what the link is and what the deep link is. What is the classification and behavior pattern of deep link, step by step, gradually into the study of the main theme of this paper. Deep link is a kind of fast link technology, is a neutral technology. It has the function of high speed searching target data information, and does not make users find their original web page or even the website jump, resulting in the illusion of the user. It is believed that all the network information resources it obtains come from the linked website. The deep link behavior will cause copyright infringement under certain circumstances. The second part starts with the Criminal Law Amendment (9). This paper analyzes the current legislative situation of network crime and the helplessness that our country can not rely on when facing the network crime before the promulgation of the Criminal Law Amendment (9). < Criminal Law Amendment (9) > the new articles aimed at the network crime. To some extent, it solves the dilemma that network crime can not be depended on. Through the analysis of the legal attributes of the deep link. The third part mainly discusses the necessity of deep link behavior incrimination. In the current social trend, network technology develops rapidly, different network users will give neutral network technology with different properties. When neutral network technology is used for legitimate behavior, its convenience greatly improves the work efficiency of network users, when used for illegal and criminal acts. Therefore, when the deep link technology is used for illegal crime, the criminal law adjustment is the most appropriate part. 4th. The author discusses two ways to incriminate deeply linked behavior. One is to help the behavior to commit the crime, the other is to commit the crime as an accomplice of the crime of infringing copyright. Although the two paths are not perfect, the author intends to throw a brick to attract jade. Hope to have more views to improve and make up for the shortcomings of existing laws.
