【摘要】：隨著刑事審判案件的多元化和復雜化,依法量刑與公正量刑之間的沖突日臻顯現(xiàn),判決對于形式化和量化的過度追求致使規(guī)范外的價值評價因素被忽略,進而使得量刑因價值判斷的缺失而偏離公正的軌道。因而,必須深刻明晰價值判斷在量刑中的重要意義,合理化解依法量刑和公正量刑之間的關系,才能實現(xiàn)使得量化契合社會大眾的期望。為此,本文從價值判斷與公正量刑的關系入手,并對公正量刑的實現(xiàn)路徑進行探究,以期為科學化量刑體系的構(gòu)建提供可行借鑒。
[Abstract]:With the diversification and complexity of criminal trial cases, the conflict between sentencing according to law and fair sentencing becomes more and more obvious, and the excessive pursuit of formalization and quantification results in the neglect of value evaluation factors outside the norms. Therefore, it is necessary to clarify the significance of value judgment in sentencing and reasonably resolve the relationship between sentencing according to law and just sentencing. Therefore, this paper starts with the relationship between value judgment and fair sentencing, and probes into the realization path of fair sentencing. In order to provide a feasible reference for the construction of scientific sentencing system.
