【摘要】：中國現(xiàn)有的憲法解釋學研究多注重宏觀的理論研究和法哲學層面的思考,缺乏在個案中對憲法解釋的理解和分析。艾爾弗斯案在德國基本權(quán)利教義學體系中具有極其重要的地位。通過此案來觀察和說明德國憲法法院對諸種憲法解釋方法的運用,以及在此基礎(chǔ)上形成論證和判決的過程,可以為中國當前的憲法解釋學研究提供有益的思路與借鑒。
[Abstract]:The existing studies of constitutional hermeneutic in China pay more attention to macro theoretical research and philosophical thinking of law, but lack of understanding and analysis of constitutional interpretation in individual cases. The Elves case plays an extremely important role in the German educational system of fundamental rights. Through this case, we can observe and explain the application of various constitutional interpretation methods by the German Constitutional Court, and the process of forming argumentation and judgment on this basis, which can provide useful ideas and references for the current study of constitutional hermeneutic in China.
