【摘要】：抵觸是我國法律中描述法律規(guī)范沖突的重要概念,代表著對法制統(tǒng)一的嚴(yán)重破壞。但是,由于理論研究的不足和語義使用的模糊,對抵觸的概念和標(biāo)準(zhǔn)一直未能達成統(tǒng)一、明確的共識。本文通過比較現(xiàn)有法律文本中對抵觸概念的不同使用,對法律規(guī)范沖突語境下抵觸的概念做了明確界定,區(qū)分了抵觸與不一致、沖突之間的關(guān)系,并以此為基礎(chǔ)提出了判定法律規(guī)范抵觸的形式標(biāo)準(zhǔn)和實質(zhì)標(biāo)準(zhǔn)。
[Abstract]:Conflict is an important concept describing the conflict of legal norms in the law of our country, which represents the serious destruction of the unity of legal system. However, due to the lack of theoretical research and the ambiguity of semantic use, there has been no unified and clear consensus on the concepts and standards of conflict. By comparing the different uses of the concept of conflict in the existing legal texts, this paper makes a clear definition of the concept of conflict in the context of the conflict of legal norms, and distinguishes the relationship between conflict and inconsistency and conflict. On this basis, the formal and substantive standards for judging the conflict of legal norms are put forward.
